CITY OF MARYSVILLE Marysvi I le, Washington ORDINANCE NO. l?/'rc AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF 42ND DRIVE N.E., SOUTH OF 92ND STREET.N.E. AND EAST OF STATE AVENUE - CHARLES B. CRUZEN. WHEREAS, by Resolution 1960 adopted on January 10, 2000, the Marysville City Council stated its intention to vacate a por'tion of 42nd Drive N.E. and being legally described on EXHIBIT A attached hereto and continued such hearing to February 14, 2000; and WHEREAS, a public hearing was held on the vacation of said street on February 7, 2000; and WHEREAS, the City Council considered the evidence presented at the hearing and entered the following findings of fact: 1. The above-described portion of 42nd Drive N.E. has remained unopened since it was originally acquired by the City, and serves no public purpose. 2. The vacation of this portion of right-of-way would not adversely affect the street pattern or circulation of the immediate area or the community as a whole. 3. The public need will not be adversely affected by the vacation of this alley. 4. No abutting owner will become landlocked nor will access to any abutting propert.ies be substantially impaired required to purchase said right-of-way from the City at a total price of $13,184.38 representing 50% of the assessed valuation of the same. 5. The abutting owners of the vacated street shall be NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That portion of 42nd Drive N.E. as legally described in EXHIBIT A is hereby vacated. ORDINANCE - 1 /wpf/mv/cruzen.ord Section 2. The above-described property shall be vacated subject to reservation of a perpetual easement in favor of the City of Marysville for sewer, water and drainage utilities over, across, under and through the property described in EXHIBIT A. Section 3. In consideration for the vacation of said street, the City shall be paid the total sum of $13,184.38 for the property conveyed to the abutting owners. said sum shall be a condition precedent of this ordinance becoming effective. Payment of Section 4. This ordinance and the vacation of the street referred to herein shall become effective five (5) days after the payment of the above-referenced sum and the publication of this ordinance and the recording of a certified copy of the same in the records of the Snohomish County Auditor.
