AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF
56TH STREET N.E., WEST OF 75TH AVENUE N.E.
WHEREAS, by Resolution 1963 adopted on January 10, 2000,
the Marysville City Council stated its intention to vacate a
portion of 56th Street N.E., west of 75th Avenue N.E., and
being legally described on EXHIBIT A attached hereto; and
WHEREAS, a public hearing was held on the vacation of
said street on February 28, 2000; and
WHEREAS, the City Council considered the evidence
presented at the hearing and entered the following findings
of fact:
1. The above-described portion of 56th Street N.E.,
west of 75th Avenue N.E., has remained unopened since it was
originally acquired by the City, and serves no public
purpose.
2. The vacation of this portion of right-of-way would
not adversely affect the street pattern or circulation of the
immediate area or the community as a whole.
3. The public need will not be adversely affected by
the vacation of this alley.
4. No abutting owner will become landlocked nor will
access to any abutting properties be substantially impaired.
5. The abutting owners of the vacated street are
willing to purchase said right-of-way from the City at a
total'price of $5,472.75 representing 50% of the assessed
valuation of the same.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MARYSVILLE, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That portion of 56th Street N.E., west of
75th Avenue N.E., aslegally described in EXHIBIT A is hereby
vacated.

Section 2. The above-described pr'operty shall be
vacated subject to reservation of a fifteen (15) foot
perpetual easement in favor of the City of Marysville for
sewer, water and drainage utiliti.es over, across, under and
through that portion of the Exhibit A property lying seven
and one-half (7%) feet on each side of the center line of the
existing %inch water main within said property.
Section 3. In consideration for the vacation of said
street, the City shall be paid the total sum of $5,472.75 for
the property conveyed to the abutting owner to the south of
said Exhibit A property. Payment of said sum shall be a
condition precedent of this ordinance becoming effective.
Section 4. This ordinance and the vacation of the
street referred to herein shall become effective five (5)
days after the
publication of
