' CITY OF MARYSVILLE Marysvi I le, Washington ORDINANCE NO. 2323 AN ORDINANCE OF THE CITY OF MARYSVILLE, WASHINGTON AMENDING ORDINANCE NO. 2068 RELATING TO THE MARYSVILLE GROWTH MANAGEMENT COMPREHENSIVE PLAN AND APPROVING THE RECOMMENDATIONS OFTHE MARYSVILLE PLANNING COMMISSION FOR TEXT AND MAP REVISIONS PURSUANT TO THE CITY'S ANNUAL AMENDMENT AND UPDATE PROCESS. WHEREAS, on April 1, 1996, the Marysville City Council enacted Ordinance No. 2068 adopting a Growth Management Comprehensive Plan for the City of Marysville; and WHEREAS, the Growth Management Act allows jurisdictions to amend comprehensive plans once per year, except in those situations enumerated in RCW 36.70A.130(2) (a); and WHEREAS, on January 27, 1997 the Marysville City Council adopted Resolution No. 1839, providing for procedures for annual amendment and update of the City's Growth Management Comprehensive Plan; and WHEREAS, the City received five property owner initiated amendments and the City also initiated two amendments on its own accord; and WHEREAS, following public notice and comment, the City issued a Declaration of Nonsignificance pursuant to the State Environmental Policy Act; and WHEREAS, the Marysville Planning Commission, after review of the proposed Comprehensive Plan amendments held a public workshop meeting February 8, 2000 and held public hearings on May 22, 2000 and received testimony from property owners, staff and other interested parties following public notice; and WHEREAS, on February 22, 2000, February 29, 2000, March 28, 2000, April 11, 2000 and May 9, 2000 the Marysville City Council reviewed the Planning Commission's recommendations relating to the proposed Comprehensive Plan amendments; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The City Council hereby adopts, in.its entirety, the recommendation of the Marysville Planning Commission relating to the proposed 1999 amendments to the Marysville Growth Management Comprehensive Plan. A copy of the Comprehensive Plan amendments and the Planning Commission recommendations as contained in the City Council Agenda Bill of May 22, 2000 are hereby incorporated by this reference and same are hereby adopted and approved by this Marysville City Counc i 1 . Section 2. The Marysville Planning Department is hereby directed to amend the text and maps of the Marysville Growth Management Comprehensive Plan consistent with the Marysville Planning Commission recommendation and the action of the City Counc i 1 . Section 3. Except as provided herein and in any other amending ordinance previously adopted, all other provisions of the Marysville Growth Management Comprehensive Plan as adopted by Ordinance No. 2068 shall remain in full force and effect, unchanged. The following summary describes the amendment requests and the final Planning Commission recommendation for each request: 1 Property owner initiated land use map revisions - There were five (5) individual requests submitted by property owners. Amendment request No. 1 was withdrawn by the applicant during the last public hearing before the Planning Commission due to a pending sale of the property. Most of these requests were for specific parcels of land with one request for a larger area that would require a UGA expansion. Each request was reviewed independently and a staff report and map was prepared. A complete copy of each file is enclosed for City Council review. Planning Commission Recommendation: Amendment Request No. 2 - Deny Amendment Request No. 3 - Approve Amendment Request No. 4 - Denial without prejudice Amendment Request No. 5 - Deny 2. Staff initiated land use map revisions and text amendments - There were two amendments proposed by staff one map amendment and one text amendment. The map amendment was to designate a pending annexation area west of 1-5 (Twin Lakes area) which would allow the City to apply zoning through the annexation process. The text amendment was to add a definition for the "downtown portion of Planning Area No. 1 .'I This definition was necessary to allow the application of specific development standards from the Zoning Code for this area. A copy of the complete staff amendment file is enclosed for City Council review.
