ORDINANCE NO. 2326
AN ORDINANCE OF THE CITY OF MARYSVILLE PROVIDING FOR THE
SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF MARYSVILLE,
AT AN ELECTION TO BE HELD THEREIN ON SEPTEMBER 19, 2000, A
PROPOSITION AUTHORIZING THE CITY TO IMPOSE A PROPERTY TAX
LEVY TO BE MADE EACH YEAR FOR SIX (6) CONSECUTIVE YEARS
COMMENCING IN 2001 AND ENDING IN 2006 IN AN AMOUNT EQUAL
TO A MAXIMUM OF FIFN CENTS PER ONE THOUSAND DOLLARS OF THE
ASSESSED VALUE OF PROPERTY IN THE CITY FOR EMERGENCY MEDICAL
CARE AND SERVICES INCLUDING PARAMEDIC SERVICES, AND PROVIDING
FOR THE ANNUAL LEVY AND COLLECTION OF TAXES FOR SUCH
PURPOSES, IF APPROVED.
WHEREAS, the City Council finds that there exists a
critical need to maintain and improve emergency medical care
and services in the City, including related personnel costs,
training for such personnel, and related equipment, supplies,
vehicles and structures needed for said services; and
WHEREAS, to maintain and improve such program it is
deemed necessary and advisable that the City impose a
property tax levy to be made each year for six (6)
consecutive years commencing in 2001 and ending in 2006 in
the amount equal to a maximum of fifty cents per one thousand
dollars of the assessed value of property in the City; and
WHEREAS, the Constitution and laws of the State of
Washington require that the question of whether or not the
City may impose said property tax levy for such purpose must
be submitted to the qualified electors of the City for their
approval,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. As used in this ordinance, the words
hereinafter defined shall have the meaning set forth in this
section:
A. "City" means the City of Marysville, Washington.
B. "Legislative Authority" means the Mayor and City
Council of the City.

C. "Emergency medical care and services" means
emergency medical care or emergency medical services,
including related personnel costs, training for such
personnel, and related equipment, supplies, vehicles and
structures needed for the provision of emergency medical care
or emergency medical services including paramedic services.
Section 2. The City Council finds that there exists a
critical need to maintain and improve emergency medical care
and services in the City. Present City budget constraints
make it impossible to continue said emergency medical care
and services without additional funding. Said needed
additional funding is available to the City through an
additional property tax.levy pursuant to RCW 84.52.069, as
amended by Chapter 224, Laws of Washington 1999, and the
Mayor is authorized to operate emergency medical care and
services including paramedic services upon said voter
approval.
Section 3. For the purposes of providing funds to
continue said emergency medical care and services, there is
hereby imposed a regular property tax levy, pursuant to RCW
84.52.069, as amended by Chapter 224, Laws of Washington
1999, in an amount equal to a maximum of fifty cents ($0.50)
per one thousand dollars ($1,000), or less as determined.by
City Council of the assessed value of property in the City,
to be collected in each year commencing January 1, 2001, for
six (6) consecutive years in an amount of a maximum of fifty
cents ($0.50) per one thousand dollars ($1,000) of assessed
value of property in the City or less as may be determined
yearly by City Council or necessary in accordance with
constitutional and statutory limitations in property tax
collections.
Section 4. The City Council finds that the provisions
of Chapter 224, Laws of Washington 1999, require the City to
place this issue before the electors and the election to be
held in the City as provided by law on September 19, 2000, at
which there shall be submitted to the qualified voters of the
City for their approval or disapproval of the following
proposition which shall read substantially as follows as
approved by the City Attorney:

Shall the City of Marysville be
authorized to impose a regular property
levy of fifty cents ($0.50) or less per
one thousand dollars ($1,000) of assessed
valuation for each of six (6) consecutive
years for collection commencing in 2001
and ending in 2006 (for continuation and
improvement of paramedic and emergency
medical care and services)?
The County Auditor of Snohomish County, ex officio Supervisor
of Elections of the County, shall have jurisdiction over and
shall conduct such special election. The City Clerk shall
deliver to the Snohomish County Auditor a certified copy of
this ordinance showing its passage and including the ballot
title herein set forth.
Section 5. Certification of such proposition by the
City Clerk to the Snohomish County Auditor in accordance with
law prior to the date of such election on September 19, 2000,
and any other act consistent with the authority and prior to
the effective date of this ordinance, are ratified and
confirmed.
Section 6. Severability. In the event any one or more
of the provisions of this ordinance shall for any reason be
held to be invalid, such invalidity shall not affect or
invalidate any other provision of this ordinance, but this
ordinance shall be construed and enforced as if such invalid
provision had not been contained therein; provided, that any
provision which shall for any reason be held by reason of its
extent to be invalid shall be deemed to be in effect to the
extent permitted by law.
