HomeMy WebLinkAboutO-2330 - Amends Sec. 18C.06.010, school district eligibility for impact fees (Repealed by 2852)CITY OF MARYSVILLE Marysville, Washington ORDINANCE NO. 2330 AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING THE CITY OF MARYSVILLE COMPREHENSIVE PLAN; ADOPTING THE CAPITAL FACILITIES PLAN OF THE MARYSVILLE SCHOOL DISTRICT NO. 25 AS A SUBELEMENT OF THE CITY'S COMPREHENSIVE PLAN; AMENDING MMC 18C.06.010; AND DECLARING AN EMERGENCY TO EXIST. WHEREAS, the Washington State Growth Management Act authorizes the adoption of school impact fees to address identified impacts of development pursuant to RCW 82.02.050 through 82.02.100; and WHEREAS, the City Council of the City of Marysville adopted Ordinance No. 2213 on November 23, 1998, enacting a new Chapter 18C of the Marysville Municipal Code relating to school impact fees; and WHEREAS, the City Council of the City of Marysville adopted Ordinance No. 2316 on March 13, 2000, amending Chapter 18C.10, MMC relating to school impact fees; and WHEREAS, the Washington Growth Management Act requires jurisdictions implementing school impact fee programs to adopt the capital facilities plans of the participating school districts as a subelement of the enacting jurisdictions' comprehensive plans; and WHEREAS, in 1998 the Marysville City Council enacted Ordinance No. 2213 amending the Marysville Comprehensive Plan and adopting the Capital Facilities Plan of the Marysville School District as a subelement of the City's Comprehensive Plan; and WHEREAS, MMC 18C.06.020 and MMC 18C.06.030 provide €or updates to a school district's capital facilities plan at least every two years; and WHEREAS, pursuant to MMC 18C.06.030, a school district's updated capital facilities plan may include revised data for the fee calculation and a corresponding modification to the impact fee schedule, consistent with the City's Comprehensive Plan; and ORDINANCE - 1 /wpf/mv/l8C.06.010.ord d/9/2000 WHEREAS, on April 17, 2000, the Marysville School Board adopted its updated Capital Facilities Plan for the years 2000-2005; and WHEREAS, the Director, as defined in MMC 18C.04.020(12), has received the Marysville School District's updated capital facilities plan and has found that said plan meets the requirements of MMC 18C.08.020; and WHEREAS, the Planning Commission held a public hearing on the District's Capital Facilities Plan on July 11, 2000; and WHEREAS, the City Council held a public hearing on the District's Capital Facilities Plan on July 24, 2000; and WHEREAS, the Washington Growth Management Act authorizes the City of Marysville to amend its comprehensive plan once per calendar year, or as a part of the adoption or amendment of the jurisdiction's budget, in response to a growth management hearings board decision, or whenever an emergency exists; and WHEREAS, in light of the rapid rate of development in the Marysville School District, the need to provide school facilities to serve development, and the projections for enrollment and facilities contained in the updated Capital Facilities Plan of the Marysville School District, an emergency is hereby declared to exist due to the fiscal impacts of delay on the District; and WHEREAS, the City Council has considered the District's .updated Capital Facilities Plan and has determined that the potential loss of impact fees and benefits to the taxpayers of Marysville constitutes an issue of community-wide significance that affects the public health, safety and general welfare; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Marysville finds that the potential loss of impact fees and benefits to thecitizens. of Marysville constitutes an issue of community- wide significance that affects the public health, safety and general welfare. Section 2. The City Council of the City of Marysville, therefore, declares that an emergency exists necessitating the preparation of a comprehensive plan amendment adopting ORDINANCE - 2 /wpf/mv/l8C.O6.010.ord 8/9/2000 the Marysville School District Capital Facilities Plan as a subelement of the City of Marysville Comprehensive Plan pursuant to RCW 82.02.050(4) and RCW 36.70A.070. Section 3. The City of Marysville Comprehensive Plan is hereby amended by adopting the.Marysville School District Capita1,Facilities Plan as adopted on April 17, 2000 and revised May 3, 2000 for the years 2000-2005 as a subelement of the City's Comprehensive Plan. Section 4. MMC 18C.06.010 is hereby.amended to read as follows : 18C.06.010 Capital facilities plan required. Any district serving the city of Marysville shall be eligible to receive school impact fees upon adoption by the council of a capital facilities plan for the district by reference as part of the capital facilities element of the city comprehensive plan. The plan shall meet the requirements of the GMA. These actions will also constitute adoption by the city of the schedule of school impact fees specified in such capital facilities plan. The Marysville School District Capital Facilities Plan, adopted April 17, 2000 by the Marysville School District Board of Directors, is hereby incorporated by this reference and is adopted as a subelement to the Marysville Comprehensive Plan. Section 5. If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such .invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. this' '/]q day of- , 2000.
