AN ORDINANCE OF THE CITY OF MARYSVILLE READOPTING AND
REIMPOSING SCHOOL IMPACT FEES AS ESTABLISHED BY
ORDINANCE NO. 2306 AS AMENDED BY ORDINANCE NO. 2326 AND
ORDINANCE NO. 2332; READOPTING AND REIMPOSING SCHOOL
IMPACT FEE DETERMINATION AS PROVIDED IN ORDINANCE N0.2331;
READOPTING AND REIMPOSING THE CAPITAL FACILITIES PLAN OF
THE CITY'S COMPREHENSIVE PLAN AS PROVIDED IN ORDINANCE NO.
2330; AND DECLARING AN EMERGENCY TO EXIST.
WHEREAS, the Marysville City Council adopted Ordinance
THE MARYSVILLE SCHOOL DISTRICT NO. 25 AS A SUB-ELEMENT OF
No. 2306 amending MMC 18C.10.010 relating to school impact
fees on December 21, 1999; and
WHEREAS, the Marysville City Council further amended MMC
18C.10.010 by the adoption of Ordinance No. 2316 on March 13,
2000, and further amended MMC 18C.10.010 by the adoption of
Ordinance No. 2332 on September 11, 2000; and
WHEREAS, on September 11, 2000 the Marysville City
Council adopted Ordinance No. 2331 amending MMC 18C.10.050
relating to school impact fee determination; and
WHEREAS, on September 11, 2000 the Marysville City
Council adopted Ordinance No. 2330 supporting the amount of
school impact fees, amending the City of Marysville
Comprehensive Plan, and adopting the Capital Facilities Plan
of the Marysville School District No. 25 as a sub-element of
the City's Comprehensive Plan; and
WHEREAS, it is the intent of the Marysville City Council
to keep intact the increase in the school impact fee as
provided in Ordinance No. 2331 adopted in September 2000; and
WHEREAS, on November 7, 2000 the people of the State of
Washington passed Initiative 722 which becomes effective on
December 7, 2000; and
WHEREAS, Section 1 of Initiative 722 renders "tax
increases" as defined in that Initiative enacted during the
period of July 2, 1999 and December 31, 1999 "null and void";
and

WHEREAS, the school impact fees established by Ordinance
No. 2306 were adopted between July 2, 1999 and December 31,
1999 and set in accordance with the law and the requirements
of municipal governance; and
WHEREAS, while Ordinance No. 2331 was adopted outside of
the time period wherein Initiative 722 would render increases
in the school impact fee null and void, because Ordinance No.
2331 amends MMC 18C.10.010 which was amended by Ordinance No.
2306 on December 21, 1999, the Marysville City Council wishes
to ensure that the school impact fee established by No. 2332
remains intact;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. The school impact fees as adopted by
Ordinance No. 2306, as amended by Ordinance No. 2316, as
amended by Ordinance No. 2332 are hereby readopted and
reimposed as set forth in Ordinance No. 2332.
Section 2. The schedule of school impact fees, the
determination of said fees, and the adoption of the
Marysville School District Capital Facilities Plan as a sub-
element of the City's Comprehensive Plan are hereby readopted
and reimposed as set forth in Ordinances No. 2330 and 2331,
and said ordinances shall remain in full force and effect,
unchanged.
Section 3. Emerqencv/Effective Date. A public
emergency is hereby declared necessary for the protection of
public health, public safety, and public property. This
ordinance shall be effective immediately upon its adoption.
Section 4. Severabilitv. If any section, subsection,
sentence, clause, phrase or word of this ordinance should be
held to be invalid or unconstitutional by a court of
competent jurisdiction, such invalidity or
unconstitutionality thereof shall not affect the validity or
constitutionality of any other section, subsection, sentence,
clause, phrase or word of this ordinance.
