HomeMy WebLinkAboutO-2345 - Readopts and reimposes sewer and water capital improvement charges (14.07)""9: f& CITY OF MARYSVILLE Marysville, Washington ORDINANCE NO. 3 3 %5" AN ORDINANCE OF THE CITY OF MARYSVILLE READOPTING AND REIMPOSING SEWER AND WATER UTILITY CAPITAL IMPROVEMENT CHARGES ESTABLISHED BY ORDINANCE NO. 2305, AND DECLARING AN EMERGENCY TO EXIST. WHEREAS, the Marysville City Council Adopted Ordinance No. 2305 on December 13, 1999 amending MMC 14.07.010(2) relating to sewer and water utility capital improvement charges; and WHEREAS, on November 7, 2000 the people of the State of Washington passed Initiative 722 which becomes effective on December 7, 2000; and WHEREAS, Section 1 of Initiative 722 renders "tax increases" as defined in that Initiative enacted during the period of July 2, 1999 and December 31, 1999 "null and void"; and WHEREAS, the sew'er and water utility capital. improvement charges established in MMC 14.07.010(2) as amended by Ordinance No. 2305 were adopted between this period and set in accordance with the law and the requirements of municipal governance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The'sewer and water utility capital improvement charges as set forth in MMC 14.07.010(2) as amended by Ordinance No. 2305 are hereby readopted and reimposed as set forth therein and on Attachment A which is hereby incorporated by this reference. Section 2. Emerqencv/Effective Date. A public emergency is hereby declared necessary for the protection of public health, public safety, and public property. This ordinance shall be effective immediately upon its adoption. Section 3. Severabilitv. If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or ORDINANCE - 1 /vpf/mv)utilfees.ord .. unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. by the City Council and APPROVED by the Mayor day of December, 2000.
