HomeMy WebLinkAboutO-2432 - Amends comprehensive plan (Special)'t=P:'V',CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO.2432 AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON AMENDING ORDINANCE NO.2068 RELATING TO THE MARYSVILLE GROWTH MANAGEMENT COMPREHENSIVE PLAN AND APPROVING THE RECOMMENDATIONS OF THE MARYSVILLE PLANNING COMMISSION FOR TEXT &MAP REVISIONS PURSUANT TO THE CITY'S ANNUAL AMENDMENT AND UPDATE PROCESS AND APPROVING THE CONCURRENT REZONE OF LAND IN ASSOCIATION THEREWITH. WHEREAS,on Aprill,1996, the MarysvilleCity Council enacted Ordinance No. 2068 adopting a Growth Management Comprehensive Plan for the City of Marysville;and WHEREAS,the Growth Management Act allows jurisdictions to amend comprehensive plans once a year, except in those situations enumerated in RCW 36.70A.130(2)(a);and WHEREAS,on January 27,1997 the MarysvilleCity Council adopted Resolution No. 1839, providing for procedures for annual amendment and update of the City's Growth Management Comprehensive Plan; and WHEREAS,on May 27, 2002 the MarysvilleCity Council adopted Ordinance No.2406, adding Chapter 18.10 of the MarysvilleMunicipal Code (MMC)entitled "Procedures For Legislative Actions"which establishes procedures for processing and review of legislativeactions relating to amendments or revision to the GMA Comprehensive Plan and Development Regulations; and WHEREAS,the City received four (4)citizen initiated map amendments known as Madeleine Villa (Comprehensive Plan Amendment #1),Cassidy Ridge (Comprehensive Plan Amendment #2),Grove Street Village (Comprehensive Plan Amendment #3)which was subsequently withdrawn by the applicant, and Getchell Investments,LLC (Comprehensive Plan Amendment #4)which was subsequently withdrawn by the applicant, and one (1)City initiated text amendment on its own accord; and WHEREAS,the 2002 Comprehensive Plan Amendments include rezoning land in association with the comprehensive plan map amendments for Madeleine Villaand Cassidy Ridge in accordance with Chapter 18.10 MMC; and WHEREAS,the Marysville Planning Commission,after review of the proposed 2002 Comprehensive Plan amendments held a public workshop on May 14 &June 25, 2002 and held a public hearing on July 23, 2002 and received testimony from property owners,staff and other interested parties following public notice; and WHEREAS,on August 26, 2002 the Marysville City Council reviewed the Planning Commission's recommendation relating to the proposed 2002 Comprehensive Plan amendments; i I I J .,.t ...''1(; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.The City Council hereby adopts, in its entirety, the recommendation of the Marysville Planning Commission relating to the two (2)citizen initiated map amendments known as Madeleine Villa (Comprehensive Plan Amendment #1)and CassidyRidge (Comprehensive Plan Amendment #2),and one (1)City initiated amendment to the Marysville Growth Management Comprehensive Plan. A copy of the Comprehensive Plan amendment and the Planning Commission recommendations as contained in the City Council Agenda Bill of August 26,2002 are hereby incorporated by this reference and same are hereby adopted and approved by this Marysville City Council. Section 2.The Marysville Community Development Department is hereby directed to amend the text and map of the Marysville Growth Management Comprehensive Plan consistent with the Marysville Planning Commission recommendation and the action of the City Council at its August 26,2002 meeting. Section 3.The Marysville Community Development Department is hereby directed to concurrently rezone land in association with the comprehensive plan map amendments for Madeleine Villa and CassidyRidge consistent with the Marysville Planning Commission recommendation and the action of the CityCouncil at its August 26,2002 meeting. Section 4.Except as provided herein and in any other amending ordinance previously adopted,all other provisions of the Marysville Growth Management Comprehensive Plan as adopted by Ordinance No.2068 shall remain in full force and effect,unchanged.. Getchell Investments,LLC Cedarcrest/Gethell Hill area 265-acres Medium Density Single Family High Density Single Family 2.A threshold determination of non-significance was issued, for each of the proposed Comprehensive Plan Amendments,on May 21,2002 to satisfy State Environmental Policy Act (SEPA)requirements.No appeals were filed on the determinations. 3.On July 10,2002,Belmark Industries submitted a letter to the Community Development Department officially withdrawing their application for the proposed Comprehensive Plan Amendment request known as Grove Street Village (Comprehensive Plan Amendment #3). 4.On June 18,2002,Wells Development I, LLC submitted a letter to the Community Development Department officially withdrawing their application for the proposed Comprehensive Plan Amendment request known as Gethcell Investments,LLC (Comprehensive Plan Amendment #4). 5.MADELEINE VILLA (Comprehensive Plan Amendment #1) At the workshop held on May 14,2002,Staff presented a recommendation to approve the proposed amendment request and rezone from General Industrial (GI)to General Commercial (GC), with conditions,outlined in the attached Staff Recommendation. The PC requested staff to research the possibility of changing the land use designation of the properties owned by Madeleine Villa from General Commercial &General Industrial to Medium Density Multi-family and allow convalescent,nursing and retirement homes to be permitted outright on multi-family designated properties. Currently,the Comprehensive Plan and Zoning Code does not permit convalescent,nursing and retirement homes outright in multi-family designated properties.The PC felt that the existing General Commercial and General Industrial zoning designations was out of character in relation to the surrounding uses to the north (high density single-family), east (high density single-family) and west (multi-family medium density)of the subject site. Additionally, policies outlined in the Comprehensive Plan encourage general commercial land uses be located near light industrial and other non-pedestrian oriented areas and at the intersection of arterial streets,where general commercial uses already exist. In order to change the land use designation to allow convalescent,nursing and retirement homes to be permitted outright in multi-family designated properties,the Comprehensive Plan and Zoning Code would have to be amended as follows. Limited to three residents per the equivalent of each minimum lot size or dwelling units per acre allowed in the zone in which it is located. 6. At theJuly 23 rd public hearing, the PC considered the Madeleine Villa (Comprehensive Plan Amendment #1)and Cassidy Ridge (Comprehensive Plan Amendment #2)proposals and their effect on the physical environment,human environment,open space, compatibility with adjacent land uses and surrounding neighborhoods,mitigation of impacts on community facilities,benefit to the area,current and projected population density in the general area, and conformance with the Comprehensive Plan. CONCLUSIONS 1.MADELEINE VIlLA (Comprehensive Plan Amendment #1) At theJuly 23 rd public hearing, the PC recommended amending the Comprehensive Plan Map and Zoning Code, as outlined above, and recommended changing the land use designation and concurrently rezoning Tax Parcel No.Is 30053300101200 &30053300104900 from General Commercial to Medium Density Multi-family and change the land use designation and concurrently rezoning Tax Parcel No.ts 30053300101300 &30053300105300 from General Industrial to Medium Density Multi-family,subject to the conditions outlined in the Staff Recommendation. 2. CASSIDY RIDGE (Comprehensive Plan Amendment #2) At theJuly 23 rd public hearing, the PC recommended changing the land use designation and concurrently rezoning Tax Parcel No.30052500300100 from Medium Density Single-family to Community Commercial,subject to the conditions outlined in the Staff Recommendation. 3.The PC hereby incorporates the "Findings and Conclusions"sections outlined in the attached Staff Recommendations into its own findings and conclusions.
