CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO.1 'f~i ~?;t9w- /Y!/LSC- ~./~, thio·,-:hk AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON AMENDING SECTION 19.12.140 (SETBACKS -FROM ALLEYS)RELATING TO BUILDING SETBACKS FROM ALLEYWAYS AND REPEALING SECTION 19.12.230 (YARD SETBACKS FOR ACCESSORY BUILDINGS)OF THE MARYSVILLE MUNICIPAL CODE THEREBY ELIMINATING A SEPARATE SECTION FOR YARD SETBACK REQUIREMENTS FOR ACCESSORY BUILDINGS WHICH HAS BEEN INCORPORATED INTO SECTION 19.08MMC. WHEREAS,the City Council of the City of Marysville does find that from time to time it is necessary and appropriate to review and revise provisions of the City's Zoning Code (Title 19 MMC); and WHEREAS,following a comprehensive review of the above-referenced City codes by City staff, the Maryville Planning Commission held a public workshop on December 10, 2002; and WHEREAS,after providing notice to the public as required by law,on January 14, 2003 the Marysville Planning Commission held a public hearing on proposed changes to the City's zoning code and received public input and comment on said proposed revisions; and WHEREAS,at a public meeting on February 10, 2003 the Marysville City Council reviewed and considered the amendments to the zoning code proposed by the Marysville Planning Commission; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.MMC 19.12.140 is hereby amended to read as follows: 19.12.140 Setbacks - From alleys. (1)Structures may be built to five feet of the property line abutting an alley,except as provided in subsection (2). (2) Vehicle access points from garages,carports or fenced parking areas shall be set back a minimum of ten feet from the lot line abutting an alley,except where the access point faces an alley with a right-of-way width of ten feet, in which case the garage carport,or fenced parking area shall not be located within 20-feet from the rear lot line.No portion of the garage or the door in motion may cross the property line. Section 2.MM C 19.12.230,which reads as follows: 19.12.230 Yard setbacks for accessory buildings. A detachedone story garage,carport or other permitted accessory building,not over750 square feet in area,maybe locatedin the rear yard;provided,that thedetached accessory building shallbe five feetor more from the rearand sidelot lines and the principal building or anyother accessory building.In thecaseof a detached accessory building on a throughlot, the building shallbelocatedno nearerto eitherstreet lot line that the depth of the required front yard on eitherstreet In thecaseof a comer lot, the building shallbe locatedno closer to the sidestreetlot line that the required yardof the adjoining lot Detached accessory buildings exceeding one story and/or 750squarefeet in areashallprovide minimum requiredyards for Date of Publication: , principal buildings in the zone.A permitteddetached accessory buildingshallcover no more than 50percent of the requiredrear yard. Severability.If any section,subsection,sentence,clause,phrase or work of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section,subsection,sentence,clause,phrase or word of this ordinance.
