WHEREAS,Chapter73,Laws of2001,effective July22,2001,authorizes the Cityto establish by ordinance an independent salary commission with authority toset thesalaryofthe members ofthe Council andofotherelectedcity officials,and provides thatthe commission's action fixingsuchsalariesshall supersede any provision ina city ordinance relatedto fixing salaries;NOW,THEREFORE THECITY COUNCIL OFTHE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section1. A newChapter 2.51 entitled "Salary Commission"is hereby addedto the Marysville Municipal Codewhichshallreadas follows: 2.51.010 Created-Membership,appointment,compensation,term. A.Thereiscreateda salary commission forthecity.The commission shallconsistof seven members,to be appointed bythe Mayor withthe approval ofthe citycouncil. B.Amemberofthe commission shallserveforathree yeartermwithout compensation,and shallbea residentofthecity.The initial members shallbe appointed for staggered termsof one,two orthree years. C.Nomemberofthe commission shallbe appointed to morethantwo terms. D.Amemberofthe commission shallnotbean officer,official,or employee ofthecityor an immediate family memberofan officer,official,or employee ofthecity.For purposes ofthis section,"immediate family member"means the parents,spouse,siblings,children,or dependent relatives ofan officer,official,or employee ofthecity,whetherornot living inthe household of theofficer,official,or employee. 2.51.020 Vacancies.Intheeventofa vacancy inofficeof commissioner,the Mayorshall appoint,subjectto approval ofthecity council,apersonto servethe unexpired portion of the termoftheexpired position. ORDINANCE - I Iwpf/mv/ord.salcomm ,. to '1" 2.51.030 Removal.A memberofthe commission shallonlybe removed from officeforcause of incapacity,incompetence,neglect of duty,or malfeasance in office,a crime involving moral turpitude,or fora disqualifying changeof residence. 2.51.040 Duties. A.The commission shall havethe duty,attwo year intervals commencing the year2003,to reviewthesalariespaid bythecitytoeachelectedcity official.If aftersuchreviewthe commission determines that thesalarypaidto anyelectedcity official should be increased or decreased,the commission shallfilea written salary schedule withthecityclerk indicating the increase or decreasein salary. B,Anyincreaseor decreaseinsalary established bythe commission shallbecome effective and incorporated intothecitybudgetforthe year following commission reviewwithout further actionofthecity councilor the commission. C.Salary increases established bythe commission shallbe effective asto all cityelected officials,regardless oftheirtermsof office. D.Salary decreases established bythe commission shall become effective as to an incumbent cityelectedofficialsat the commencement oftheirnext subsequent termsof office. 2.51.050 Referendum.Anysalary increase ordecrease established bythe commission pursuant to thischaptershallbe subjectto referendum petitionbythe votersofthecity, inthesame manneras a city ordinance,uponfilingof a referendum petition withthecityclerkwithin thirtydaysafterfilingof a salary schedule bythe commission.In theeventofthefilingof a valid referendum petition,the salary increase or decrease shallnot gointoeffect until approved bya voteofthe people.Referendum measures underthis section shallbe submitted to the votersof the cityat the next following general or municipal electionoccurringthirty daysor moreafterthe petition is filed,andshall otherwise be governed bythe provisions of the State Constitution andthelaws generally applicable to referendum measures.By adoption ofthis provision it shall notbethe intent toadoptthe powers of Referendum generally. Section2. This ordinance shalltakeeffectand beinfull force five days from andafter its passage,approval and publication,as required bylaw. Section 3.Severability,If any section,subsection,sentence,clause,phraseor word of this ordinance shouldbeheldto be invalid or unconstitutional bya courtof competent jurisdiction,such invalidity or unconstitutionality thereofshallnotaffectthe validityor constitutionality of anyother section,subsection,sentence,clause,phraseorwordof this ordinance.
