J.,/>~L,r~op4 !Xf-Sc... ~tJVcJ" CITY OF MARYSVILLE ~arysville,\Vashington ORDINANCE NO.2 '/8G> AN ORDINANCE OF THE CITY OF MARYSVilLE ADOPTING SURFACE \VATER UTll"ITY RATES EFFECTIVE JANUARY 1,2004 FOR THE YEARS 2004 THROUGH 2006 AND ~NDING ~C CHAPTER 14.19. ·."'~;; WHEREAS,pursuant to Ordinance No.2245 (codified inpartat Chapter 14.19 ofthe Marysville Municipal code),theCityestablished a Surface Water Utility for properties within the Marysville Corporate limits;and . WHEREAS,in December 2001,theCity Commissioned a Comprehensive Storm WaterRate study bya qualified consultant;and WHEREAS,said study,using generally accepted rate setting techniques,proposed recommended Surface Water Utility rates forthe purpose of assisting the City in achieving revenue requirements necessary for compliance with regulatory requirements and identified capital improvements;and WHEREAS,on December 10,2002,the Marysville Planning Commission held a public hearing to consider the Surface Water Rate Study,including the recommended Surface Water Utility rates;and WHEREAS,on December 10,2002,the Marysville Planning Commission approved the recommended Surface Water Management Plan and the recommended Surface Water Utility rates as proposed bytheCity's consultant;and WHEREAS,on April 28,2003,the Marysville City Council considered the recommendation ofthe Marysville Planning Commission toadoptthe schedule of proposed Surface Water Utility rates proposed bytheCity's consultant;and WHEREAS,pursuant toan Interlocal Agreement with Snohomish County,Snohomish County is authorized to levy and collect Surface Water Utility service charges against all properties within the County's Quilceda Creek /Allen CreekWatershed Management Area and to disperse said charges totheCitywhich are collected bythe County from properties within the City;and WHEREAS,theCity and Snohomish County are presently negotiating a revised interlocal agreement which will require the incorporation ofthenew Surface Water Utility rates adopted by this ordinance; ORDINANCE 1 Iwpf7mv/ord.surface water utilityrates NOW,THEREFORE,THECITY COUNC~OFTHE CITY OF MARYSVILLE, WASHlNGTON DO ORDAIN AS FOLLOWS: Section 1.Effective January 1,2004the Schedule of Surface Water Utility Rates attached hereto as Exhibit 1 and the categories of non-residential customers associated therewith are hereby adopted forthe years 2004through 2006.Theratesforthe years 2005and2006 shall become effective on January 1ofthose years. Section 2. The Schedule of Surface Water Utility Rates attached hereto as Exhibit 1 shall be incorporated into an interlocal agreement with Snohomish County forthe purpose of authorizing Snohomish County to levy and collect said Surface Water Utility ratesforall properties subject thereto within the city limits of Marysville andfor disbursement to the City the as provided inChapter 14.19 ofthe Marysville Municipal Code.In the eventthe City of Marysville undertakes the levy and collection of Surface Water Utility ratesandoptsnotto have Snohomish County undertake said levy and collection,or in the event the interlocal agreement between Snohomish County and the City expires or is terminated,theCityof Marysville shall continue to levy and collect the Schedule of Surface Water Utility Rates attached hereto as Exhibit 1. Section 3. All provisions of Ordinance 2245 as codified in Chapter 14.19 ofthe Marysville Municipal Code which are inconsistent with this ordinance,including,butnot limited to the Schedule of Surface Water Utility Rates assetforthin Exhibit 1are hereby amended to be consistent herewith. Section 4.Severability.If any section,subsection,sentence,clause,phrase orwordof this ordinance should be held to be invalid or unconstitutional bya court of competent jurisdiction,such invalidity or unconstitutionality thereofshall not affect the validity or constitutionality of any other section,subsection,sentence,clause,phrase or wordofthis ordinance.
