HomeMy WebLinkAboutO-2493 - Adopts surface water utility rates; amends Ord. 2486 (14.19)CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO.;l.'f 9 3 AN ORDINANCE OF THE CITY OF MARYSVILLE ADOPTING SURFACE WATER UTILITY RATES EFFECTIVE JANUARY 1,2004 FOR THE YEARS 2004 THROUGH 2006 AND AMENDING ORDINANCE 2245 CODIFIED IN MMC CHAPTER 14.19 AND AMENDING THE EXHIDIT 1 SCHEDULE OF SURFACE WATER UTILITY RATES SETFORTH IN ORDINANCE 2486. WHEREAS,pursuant to Ordinance No.2245 (codified inpartatChapter 14.19 ofthe Marysville Municipal code),theCity established a Surface Water Utility for properties within the Marysville Corporate limits;and WHEREAS,in December 200I, theCity commissioned a Comprehensive Storm Water Ratestudybya qualified consultant;and WHEREAS,said study,using generally accepted rate setting techniques,proposed recommended Surface WaterUtilityratesforthe purpose of assisting theCityin achieving revenue requirements necessary for compliance with regulatory requirements and identified capital improvements;and WHEREAS,on December 10,2002,the Marysville Planning Commission helda public hearing toconsiderthe Surface WaterRate Study,including the recommended Surface Water Utility rates;and WHEREAS,on December 10,2002, the Marysville Planning Commission approved the recommended Surface Water Management Planandthe recommended Surface WaterUtilityrates as proposed bythe City's consultant;and WHEREAS,onApril28,2003,the Marysville City Council considered the recommendation of the Marysville Planning Commission to adoptthe schedule of proposed Surface WaterUtilityrates proposed bytheCity's consultant;and WHEREAS,pursuant to an Interlocal Agreement with Snohomish County,Snohomish County is authorized to levyand collect Surface WaterUtility service charges against all properties withintheCounty's Qui1ceda Creek/ Allen Creek Watershed Management Areaandto disperse said charges totheCitywhichare collected bythe County from properties withinthe City;and WHEREAS,theCityand Snohomish County are presently negotiating a revised interlocal agreement whichwill require the incorporation ofthenew Surface WaterUtilityrates adopted by this ordinance; ORDINANCE 1 Iwpf/mv/ord.surfacc wtr ut rates exhibit I and repeal ,. ;~-,......... ------_._------------------------------. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Effective January I, 2004 the Schedule of Surface Water Utility Rates attached hereto as Exhibit 1 and the categories of non-residential customers associated therewith are hereby adopted for the years 2004 through 2006. The rates for the years 2005 and 2006 shall become effective on January 1 of those years. Section 2. The Schedule of Surface Water Utility Rates attached hereto as Exhibit 1 shall be incorporated into an interlocal agreement with Snohomish County for the purpose of authorizing Snohomish County to levy and collect said Surface Water Utility rates for all properties subject thereto within the city limits of Marysville and for disbursement to the City the as provided in Chapter 14.19 of the Marysville Municipal Code.In the event the City of Marysville undertakes the levy and collection of Surface Water Utility rates and opts not to have Snohomish County undertake said levy and collection,or in the event the interlocal agreement between Snohomish County and the City expires or is terminated,the City of Marysville shall continue to levy and collect the Schedule of Surface Water Utility Rates attached hereto as Exhibit 1. Section 3 All provisions of Ordinance 2245 as codified in Chapter 14.19 of the Marysville Municipal Code which are inconsistent with this ordinance,including,but not limited to the Schedule of Surface Water Utility Rates as set forth in Exhibit 1 are hereby amended to be consistent herewith. Section 4 Ordinance 2486 adopted by the City Council on August 25, 2003 is hereby amended by replacing the Exhibit 1 Schedule of Surface Water Utility Rates with the schedule attached hereto as Exhibit 1. Section 5 Severability.If any section,subsection,sentence,clause,phrase or word ofthis ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section,subsection,sentence,clause,phrase or word of this ordinance. The categories are defined as follows: Very Light Light Moderate Heavy Very Heavy 1% to 19%impervious area 20% to 39%impervious area 40% to 59%impervious area 60% to 79%impervious area 80% to 100%impervious area Any land use classifications not specifically identified in relationship to the above rate categories will default toTitle 25 of the Snohomish County Code.
