AN ORDINANCE OF THE CITY OF MARYSVILLE ANNEXING AND
ZONING A CERTAIN UNINCORPORATED AREA,KNOWN AS THE
LOOP ANNEXATION INTO THE CITY OF MARYSVILLE.

WHEREAS,theCityof Marysville received a petition for annexation of theproperty
described in Exhibit A attached hereto,said petition having been signed or consented to by
the owners of the not less thansixtypercent (60%)of the assessed value of said property;
and
WHEREAS,a duly-advertised public hearing was heldonsaid petition before the
Marysville City Council on November 26,2001 andsaid Council passed Resolution No.
2049 stating the City's intention to annexthe propertyupon receipt ofa favorable report
fromthe Snohomish County Boundary Review Board;and
WHEREAS,on March 8,2002,the 45-day statutoryperiodfor review before the
Snohomish County Review Board expired;and
WHEREAS,on March 14,2002the State Supreme Court ruled the petition method
of annexation unconstitutional,and annexation ofthe property described in Exhibit A was
not formally adoptedby Ordinance prior to this ruling;and
WHEREAS,on january 29,2004the State Supreme Court reversed their decision on
thepetitionmethodof annexation,rendering the petition method constitutional,allowing
jurisdictions to process petitions that were previously certified;and
WHEREAS,the Cityof Marysville is eleeting to adoptthe originally certified
annexation knownasthe Loop annexation,described in Exhibit A;NOW,TIffiREFORE,
TIffi OTY CDUNOL OF TIffi OTY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1.The above-described property,being situated inthe unincorporated area
of Snohomish County,State of Washington,and being contiguous,proximate and adjacent
to thepresent corporate limits of the City of Marysville,beandthe same isherebyannexed
to and incorporated intothe Cityof Marysville.
Section 2. The above-described property shall hereafter be assessed and taxed atthe
same rateandon the same basis asotherproperty within the City of Marysville,including
assessments or taxes in payment ofallof the outstanding indebtedness of the Gty
contracted or incurred priorto,or existing on,the effective dateof this ordinance.
Section 3. The Comprehensive Planfor the City of Marysville designating the
above-described propertyinthe Single-Family,High Densityclassification shall applyto said
propertyandthe property shall beandisherebyzoned R-6.5.
The City's official zoning map shall be amended to be consistent withsaid zoning.
Section 4.EFFECTIVE DA1E. The effective date of this ordinance shall be May
1,2004.
Section 5.Severability.If any section,subsection,sentence,clause,phrase orwork
of this ordinance should beheldto be invalid or unconstitutional byacourtof competent
jurisdiction,such invalidity or unconstitutionality thereof shall not affect the validity or
