HomeMy WebLinkAboutO-2552 - Adds Sec. 14.18.110, Marysville area regional storm water ponds and conveyance systems (14.18).-------~-----------------------------------..,.. r,..\,1 , ~.':l ...'-0' CITY OF MARYSVILLE Marysville, Washington ORDINANCE NO.J,SSJ-- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE WASHINGTON ADDING A NEW SECTION 14.18.110, TO THE MARYSVILLE MUNICIPAL CODE RELATING TO REGIONAL STORM WATER PONDS AND CONVEYANCE SYSTEMS; AND ESTABLISHING POLICY,PROCEDURES AND PRIORITIES FOR COMMERCIAL PROPERTIES TO CONNECT TO MARYSVILLE AREA REGIONAL STORM WATER PONDS AND CONVEYANCE SYSTEMS. ~CO~ ~!?d-­ /11A':.-5C- <c WHEREAS, by Chapter 14.16 of the Marysville Municipal Code the City provides for the establishment of public storm water systems; WHEREAS, MMC 14.18.060 provides for the construction of regional drainage facilities; WHEREAS, the City began construction in April 2004 and is about to complete construction of the North Marysville Area Regional Storm Water Pond and Conveyance System; WHEREAS, subject to adequate funding and demand, it is anticipated that other storm water ponds and conveyance systems may be constructed to promote economic development; WHEREAS, the City Council now wishes to establish policy, procedures and priorities for commercial properties to connect to such ponds and conveyance systems; NOW, THEREFORE, the City Council of the City of Marysville do ordain as follows: Section I.A new section 14.18.110 entitled "Marysville Area Regional Storm Water Ponds and Conveyance Systems" is hereby added to the Marysville Municipal Code which shall read as follows: ORDINANCE - 1 W/wpf/mv/ord.ponds ..,,. e >.• 14.16.110 MARYSVILLE AREA REGIONAL STORM WATER PONDS AND CONVEYANCE SYSTEMS In addition to any other requirements of the Marysville Municipal Code, and in particular Chapters 14.16 and 14.18 MMC, the following policies, procedures and priorities are hereby established for connection to and use of all Marysville Area Regional Storm Water Ponds and Conveyance Systems which are now or hereafter constructed by the City of Marysville: (a) Regional Storm Water Ponds and Conveyance Systems shall only be used to receive waters from commercial or industrial development on properties bearing the zoning designations of Community Business, General Commercial, Mixed Use, Light Industrial or Business Park. (b) Connection to and discharge into any Regional Storm Water Pond and Conveyance System shall not be made, until the applicant has been issued a building permit for commercial or industrial development on a property bearing one or more of the zoning designations referenced in MMC 14.16.l50(a)above. (c) All Regional Storm Water Ponds and Conveyance Systems have a limited capacity. Acceptance of an application and discharge into the system shall be contingent upon available capacity. Applications shall be given priority based upon the date the initial deposit has been received as referenced in subsection (e) below bythe City. (d) A fee for connection to all regional stormwater drainage facilities shall be established by the City Engineer. Said fee shall be determined by calculating the total cost of the detention facility and dividing said cost by the cubic feet of as built capacity. Total cost shall include land acquisition, design, construction, construction management, City staff overhead and environmental/ecological mitigation. (e) All properties qualifying to connect to a regional stormwater drainage facility shall pay a nonrefundable 10% deposit for the connection fee at the time of City receipt of an application for connection to the regional stormwater facilty following the effective date of this ordinance. Said application shall describe the property to be served by the regional stormwater facility, the proposed development, and the storage volume requested.An additional 10% ORDINANCE - 2 W/wpf/mv/ord.ponds refundable deposit shall be paid at the time of City receipt of any building permit application on the described property which must be within one hundred twenty (120) days of the City receipt of the approved regional pond application or right to capacity within the stormwater drainage facility shall be forfeited. The balance of the fee shall be paid at the time of issuance of the first building permit for the property to be served.If a building permit has not been issued within one hundred twenty (120) days of the City receipt of a building permit application the right to capacity within the stormwater drainage facility shall be forfeited. The City may grant a time extension of up to 120 days for building permit if substantial progress has been made by the applicant to complete design and construction plans to receive permit approval. (D Non-transferability.All rights conferred by this ordinance shall inure solely to the development applicant and shall not be transferable, sold, assigned or in any way conveyed to any third party. Said rights shall not run with the land and shall inure solely to the benefit of the development applicant.
