AN ORDINANCE OF TIlE CITY OF MARYSVILLE, WASHINGTON
AMENDING MMC 14.07.010(2)RELATING TO SEWER AND WATER
UTILITY CAPITAL IMPROVEMENT CHARGES AND REPEALING
ORDINANCENO. 2542.
WHEREAS,RCW 35.92.025 authorizes the legislative body
of a city to enact charges to property owners seeking to
connect to the water or sewerage system of the city as a
condition to granting the right to so connect;and
WHEREAS,RCW 36.92.025 authorizes the imposition of such
reasonable connection charges as the legislative body of a
city shall determine proper in order that property owners
bear their equitable share of the cost of the city's sewer
and water utility system;and
WHEREAS,annually the City prepares a capital
improvement program for the City's system of utilities which
identifies the City's planned capital needs;and
WHEREAS,the City has studied the growth projections
within the City's utility service area and has prepared
comprehensive water and sewer plans based upon such
projections;and
WHEREAS,on October 25,2004 the Marysville City Council
adopted Ordinance No.2542 amending MMC 14.07.010(2)and
revising the capital improvement charges for water and sewer
connections;and
WHEREAS,on November 22,2004 the Marysville City
Council reconsidered its action in adopting Ordinance No.
2542 and determined that the schedule of capital improvement
charges adopted therein were not sufficient to establish a
sufficient cash reserve for capital projects and that said
action could affect the marketability of future bond issues;
and
WHEREAS,the Marysville City Council finds that an
increase in capital improvement charges which is tiered,a
portion of which becomes effective January 1,2005 and a
portion of which becomes effective January 1,2006 for
residential units is necessary and appropriate to meet
anticipated revenues for its capital improvement program;and

WHEREAS,the City has evaluated the utility system
capital needs for new customers and the projected new
connections over the next 20 years,and has prepared a
revised schedule of fees as are set forth on Attachment A;
and
WHEREAS,the City Council hereby finds that the proposed
fees are reasonable and provide for property owners
connecting to the City's system of utilities to bear their
equitable share of the cost of such utility system;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS:

MMC 14.07.010(2)is hereby amended to read
Attachment A,which is hereby incorporated by
Section 2.Pending Development Applications and
Building Permits.Until January 1,2005,all applicants who
have received final plat approval,final binding site plan
approval,final commercial/multifamily site plan approval,a
conditional use permit,or for previously platted individual
lots,a building permit by the permitting authority,shall be
subject to the schedule of fees in MMC 14.07.010(2)which
were in effect prior to the adoption of Ordinance No.2542.
From and after January 1,2005 the schedule of fees and the
effective dates set forth on Attachment "A"shall apply.
Except as specifically provided herein,this section shall
not serve to amend any other provisions of the City's utility
code which provide for the conditions under which utility
connections shall be sold or installed.
Section 4.Effective Date.This ordinance shall become
effective five (5)days after publication;provided,however,
the schedule of fees set forth on Attachment A shall become
effective on the dates set forth therein.
