HomeMy WebLinkAboutO-2569 - Repeals and adopts comprehensive plan (Special),------------------------------------------ CITYOF MARYSVILLE Marysville,Washington ORDINANCE No.JS6 1 AN ORDINANCE OF THE CITY OF MARYSVILLE, WASHINGTON,SETTING FORTH THE BASIS OF THE CITY'S COMPLIANCE WITH THE GROWTH MANAGEMENT ACT'S REQUIRED REVIEW AND UPDATING OF THE CITY'S COMPREHENSIVE PLAN AND DEVELOPMENT REGULATIONS UNDER RCW 36.70A.130(4)(a),IDENTIFYING REVISIONS TO THE CITY'S COMPREHENSIVE PLAN AND DEVELOPMENT REGULATIONS AS NEEDED TO ENSURE COMPLIANCE WITH THE GMA,REPEALING THE COMPREHENSIVE PLAN ADOPTED IN ORDINANCE 2068, AND ADOPTING A NEW COMPREHENSIVE PLAN, SEWER COMPREHENSIVE PLAN, TRANSPORTATION PLAN, PARKS AND RECREATION PLAN, AND SCHOOL DISTRICT CAPITAL FACILITIES PLANS. WHEREAS,as one of the cities in Snohomish County, the City of Marysville is required under RCW 36.70AI30(4)(a)to review and,if needed, revise its comprehensive plan and development regulations to ensure the plan and regulations comply with the Growth Management Act (GMA); and WHEREAS, the Washington State Department of Community,Trade, and Economic Development (CTED) has recommended that cities and counties required to comply with with RCW 36.70AI30(4)(a)follow a three part process, including (I)establishing a public participation program that complies with RCW 36.70A.035,RCW 36.70A130,and RCW 36.70A.l40,(2)reviewing the comprehensive plan and development regulations and identifying needed revisions to ensure compliance with the GMA, and (3) adopting the identified revisions to the comprehensive plan and development regulations; and WHEREAS, the City of Marysville has met the spirit and intent ofRCW 36.70A.l30(4)(a) by (I)establishing the public participation program set forth in the attached Exhibits A and B and described in Section 2 below, by (2)reviewing and identifying needed revisions to the Comprehensive Plan and development regulations,as described in Section 3 below and in the Planning Commission's recommendation set forth in the attached Exhibit A and as set forth in the attached Exhibit B, and by (3) adopting a new Comprehensive Plan as set forth in the attached Exhibit B; and WHEREAS, in the process of updating its existing Comprehensive Plan that was adopted in April, 1996, the City of Marysville has also considered updated versions of the Transportation ORDINANCE - 1 Iwpf/mv/on:l.Comp Plan Update l ~,". Plan and Comprehensive Parks and Recreation Plan as set forth in Exhibit B, the Sewer Comprehensive Plan as set forth in Exhibit C, and the Capital Facilities Plans of the Lake Stevens and Lakewood School Districts as set forth in Exhibits D and E, respectively; and WHEREAS, the City of Marysville has also considered the updated Capital Facilities Plan of the Marysville School District but at the District's request has agreed to delay adoption of the Plan until a later date; and WHEREAS, the City of Marysville will continue to meet the spirit and intent ofRCW 36.70A130(4)(a)by coordinating its GMA update actions with Snohomish County and other relevant entities and by considering the future actions described in Section II below; and WHEREAS,in taking the actions set forth in this Ordinance,the City of Marysville has coordinated with Snohomish County and other cities to ensure consistency with the County's comprehensive plan and with the comprehensive plans of other cities with which Marysville has regional related issues, as required by RCW 36,70A I00; and WHEREAS, in taking the actions set forth in this Ordinance,the City of Marysville has made a good faith effort to comply with the recommendations of CTED and has submitted to CTED the proposed needed revisions to the City's Comprehensive Plan and development regulations as required by RCW 36.70A I06; and WHEREAS, in taking the actions set forth in this Ordinance,the City of Marysville has obtained the review and recommendations of various state and regional governmental entities, such as the Washington State Department of Ecology; and WHEREAS, in taking the actions set forth in this Ordinance, the City of Marysville has complied with the requirements of the State Environmental Policy Act,Ch.43.2IC RCW, (SEPA) by adopting a determination of significance and preparing an environmental impact statement (EIS), the Final EIS having been issued on April 12, 2005, as set forth in the attached Exhibit B; and WHEREAS,the City received numerous comments on the revisions to the Comprehensive Plan and development regulations from citizens, envirorunental groups,developer organizations,and government entities, which comments the City responded to in the Final EIS and has duly considered in adopting the needed revisions to the Comprehensive Plan and development regulations; and WHEREAS, before adopting the needed revrsions to the Comprehensive Plan and development regulations, the City Council has met with the Planning Commission in a workshop to review the Commission's recommendation as set forth in the attached Exhibit A and has conducted its own public hearing; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, ORDINANCE - 2 /wpflmv/ord.Comp Plan Update ---------------------------------------------------------------- 'J -, WASHINGTON DO ORDAIN AS FOLLOWS: Section I. Purpose. The purpose of this Ordinance is to set forth the actions taken by the City of Marysville to comply with the Growth Management Act's requirement under RCW 36.70AI30(4)(a) that the City review and make revisions needed to ensure that the City's Comprehensive Plan and development regulations comply with the GMA As specifically described and set forth in Sections 2 through 10below, the City's actions include (I)establishing a public participation program, (2)reviewing and identifying needed revisions to the Comprehensive Plan and development regulations,and (3) adopting needed revisions to the Comprehensive Plan and development regulations. As specifically described and set forth in Section II below, the City is committing to consider additional actions as needed to coordinate with Snohomish County and other relevant entities and to further meet the spirit and intent ofRCW 36.70A130(4)(a). Section 2. Public Participation Program. The City of Marysville has established and implemented a public participation program for reviewing and identifying needed revisions to the City's Comprehensive Plan and development regulations to ensure that the Plan and regulations comply with the GMA The public participation program consists of the meetings and hearings set forth in the attached Exhibits A and B. The program has provided for broad dissemination of proposals and alternatives, opportunity for written comments,public meetings after effective notice, provision for open discussion,communication programs,information services, and consideration of and response to public comments.Notice of the public meetings and hearings was given by: (a)mailing notices to property owners and residents; (b)publishing notices in newspapers of general circulation in the City and region; (c) notifying public and private groups with known interest in a certain proposal or type of proposal being considered; (d)posting notices at City buildings and the post office; and (e) making copies of the proposals and alternatives available for purchase or for review at the public library, City website, and City Hall. Section 3.Review and Identification of Needed Revisions to the Comprehensive Plan and Development Regulations. The City of Marysville has conducted a thorough review of the City's Comprehensive Plan and development regulations to identify revisions needed to ensure compliance with the GMA This review has been conducted by the City's Planning Commission,staff, and citizens and has utilized the public participation program set forth in Section 2 above. This review has focused on changes in the GMA and related laws that have occurred since the original adoption of the City's current Comprehensive Plan,including but not limited to the following: ORDINANCE - 3 /wpf/mv/crd.Comp Plan Update " (a)utilization of best available science in critical areas regulations; (b)compliance with the Endangered Species Act; (c)application of Census 2000 data and population projection updates from the Office of Financial Management to urban growth policies and regulations; (d)accommodation of essential public facilities,affordable housing,transportation infrastructure,and public facilities and services for future needs; (e)npdating shoreline and stonnwater policies and regulations; (f)achieving consistency between the comprehensive plan and development regulations; and (g)integration of environmental review with the permit process. Based on this review,the City has identified needed revisions to the Comprehensive Plan and development regulations,which are summarized in the Planning Commission's recommendation as set forth in the attached Exhibit A and which are set forth in the attached Exhibit B. Section 4.Approval of Planning Commission's Recommendation and Adoption of Findings. The City Council hereby approves the Planning Commission's recommendation and adopts the Commission's findings, as set forth in the attached Exhibit A and incorporated herein by this reference. Section 5.Repeal of Existing Comprehensive Plan. The City Council hereby repeals the existing Comprehensive Plan that was adopted in Ordinance 2068. Section 6.Adoption of New Comprehensive Plan. The City Council hereby adopts a new Comprehensive Plan,which has been identified as necessary to ensure compliance with the GMA as set forth in Section 3 above and which is attached hereto as Exhibit B and is incorporated herein by this reference. Section 7.Adoption of New Transportation Plan. The City Council hereby adopts the revisions and updates to the Transportation Plan, as set forth in the Comprehensive Plan's Transportation Element attached hereto in Exhibit B. Section 8.Adoption of New Comprehensive Parks and Recreation Plan. The City Council hereby adopts the new Comprehensive Parks and Recreation Plan, as set forth in the Comprehensive Plan's Parks and Recreation Element attached hereto in Exhibit B. ORDINANCE - 4 Iwpf/mv/ord.Comp Plan Update ,.~,~..., Section 9.Adoption of Sewer Comprehensive Plan. The City Council hereby adopts, as a subelement of the Comprehensive Plan's Public Facilities and Services Element,the Sewer Comprehensive Plan, which is attached hereto as Exhibit C and is incorporated herein by this reference. Section 10.Adoption of School District Capital Facilities Plans. The City Council hereby adopts, as subelements of the Comprehensive Plan's Capital Facilities Element,the Capital Facilities Plans for 2004-2009 of the Lake Stevens School District NO.4 and the Lakewood School District No. 306,which are attached hereto as Exhibits D and E, respectively,and are incorporated herein by this reference. Section II.Future Actions. In addition to the actions set forth above, the City of Marysville hereby commits that it will consider further actions in order to coordinate with Snohomish County and other relevant entities and to ensure consistency with the County's comprehensive plan and in order to further meet the spirit and intent of RCW 36.70A.130(4)(a). These future actions include the consideration of necessary revisions to the Comprehensive Plan and development regulations to take intoaccount the following: (a)revisions by Snohomish County to the Marysville Urban Growth Area that may not have been anticipated by the City; (b) new state regulations applicable to the City's Shoreline Master Program and essential public facilities policies;and (c)adoption of the updated Capital Facilities Plan of the Marysville School District No. 25. Section 12.Severability. If any section,sentence,clause,of phrase of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction,such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section,sentence,clause,or phrase of this Ordinance.
