HomeMy WebLinkAboutO-2596 - Adds Sec. 11.04.032, speed limits (11.04)-,," CITYOF MARYSVILLE Marysville,Washington ORDINANCE NO.;LS-q"" AN ORDINANCE OF TIIE CITY OF MARYSVILLE CREATING A NEW CODE SECTION CODIFIED AS 11.04.032 ESTABLISHING TIIE MAXIMUM SPEED LIMITS ON SR 528 BETWEEN MILE POST 0.49 (ALDER STREET VICINITY) AND MILE POST 0.80 (47TIl AVENUE NORTIIEAST)AND ON SR 528 BETWEEN MILE POST 2.54 (74 TIl DRIVE NORTIIEAST VICINITY) AND STATE ROlITE 9; AND SEVERABILITY. WHEREAS,the Revised Code of Washington (RCW)inthe Model Traffic Code, adopted bythe City,provides in RCW 46.61.415 and WAC 308-330-270 thatthe local authority mayafteran engineeringandtraffic investigation byatrafficengineerincreaseor decrease maximum speedlimits; and WHEREAS,WSDOT andCity engineering and traffic investigations found inDraft "StateRoute528and StateRoute529City of Marysville SpeedLimits"preparedby Northwest RegionTrafficCentral Operations Washington StateDepartmentof Transportation, datedMay20,2005;have concluded and support an increase ofthe maximum speedlimiton SR528 between milepost0.49(Alder Street vicinity)andmilepost0.80 (47th Avenue Northeast)andon SR 528 between milepost2.54 (74th Drive Northeast vicinity)andState Route 9;and WHEREAS,RCW49.24andWAC 46.61.415 require approval fromthe Secretary of Transportation for alteration of maximum speedlimitsonState Highways within incorporated citiesor towns;and WHEREAS,SR528 between milepost0.49 (Alder Street vicinity)andmilepost0.80 (47th Avenue Northeast)andSR528 between milepost2.54 (74th Drive Northeast vicinity)and State Route 9, isa State Highway ("SR528");and WHEREAS,the Washington State Department of Transportation,onbehalf of the Secretary of Transportation,has offered preliminary approval byDraft"State Route528and StateRoute529 City of Marysville SpeedLimits"preparedbyNorthwestRegionTraffic Central Operations Washington State Department of Transportation,dated May 20,2005,and theCitywillnotcausethis ordinance to become effective until theCity receives final approval from the Washington State Department of Transportation,onbehalf of the Secretary of Transportation. THECITY COUNCIL OFTHECITYOF MARYSVILLE,WASHINGTON DO ORDINANCE - 1 Iwpflmvlord.speed limit2005SR528 f ORDAIN AS FOLLOWS: Section I. The Marysville City Council hereby adopts and incorporates by reference the engineering investigation and findings as set forth in the Draft "State Route 528 and State Route 529 City of Marysville Speed Limits"prepared by Northwest Region Traffic Central Operations Washington State Department of Transportation,dated May 20, 2005; and Section 2. A new Section 11.04.032 of the Marysville Municipal Code is created and shall read as follows: 11.04.032 Maximum speed on SR 528 (I)..The maximum speed on SR 528 between mile post 0.49 (Alder Street vicinity) to mile post 0.80 (47 th Avenue Northeast) unless otherwise posted, shall be 35 miles per hour.Violation of this section shall constitute a traffic infraction under RCW 46.61.400 and incorporated by the City. (2). The maximum speed on SR 528 between mile posts 2.54 (74 th Drive Northeast vicinity) and State Route 9 unless otherwise posted, shall be 45 miles per hour.Violation of this section shall constitute a traffic infraction under RCW 46.61.400 and incorporated by the City. Section 3.Effective Date The Washington State Department of Transportation, on behalf of the Secretary of Transportation, has offered preliminary approval by Draft "State Route 528and State Route 529 City of Marysville Speed Limits"prepared by Northwest Region Traffic Central Operations Washington State Department of Transportation,dated May 20,2005,however the City will not cause this ordinance to become effective until the City receives final approval from the Washington State Department of Transportation, on behalf of the Secretary of Transportation and or 5 days after publication which ever occurs last. Section 4.If any section,subsection,sentence,clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section,subsection,sentence,clause, phrase or word of this ordinance. rln*!.1'ASSED by the City Council and APPROVED by the Mayor this ~day of ~·lL__----:~'2005.
