HomeMy WebLinkAboutO-2610 - Street vacation (Special)------------------ ?e-:~Afk- 111 /L-5C ~~ ~..~ CITYOF MARYSVILLE Marysville,Washington ORDINANCE NO.Z-b'O AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF UNIIMPROVED TWIN LAKES AVENUE RIGHT- OF-WAY,SOUTHOF 169'11 St NE AND WESTOF TWIN LAKES AVENUE,BEING LEGALLY DESCRIBED ON EXHIBIT A AITACHED HERETO;AND WHEREAS,a public hearing was held on the vacation of said street on December 12,2005;and WHEREAS,the City Council considered the evidence presented at the hearing andenteredthe following findings of fact: 1.The above-described portion of Twin Lakes Avenue NE remained unopened since it was originally acquired by the City,and serves no public purpose. 2. The vacationof this portionof right-of-way wouldnotadverselyaffectthe street pattern or circulation of the immediate area or the community as a whole. 3.The public need will not be adversely affected by the vacation of this right-of-way because when the petitioner's property is developed, adequate provisions willbe made for streets. 4. No abuttingowner will become landlocked nor will accessto any abutting propertiesbe substantially impaired. 5. The abutting owners of the vacated street are willing to purchase said right-of-way from theCityat a total priceof $5,178.79 representing 100% of theassessedvaluationof the same. 6. The vacation of this portion of Twin Lakes Avenue will not adversely affectthestreetpatternor circulation of the immediate area; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.That portion of Twin Lakes Avenue as legally described m EXHIBIT A is hereby vacated. ORDINANCE -1 Powell Street Vacation Section 3. In consideration for the vacation of said street, the City shall be paid the total sum of $5,178.79 for the property conveyed to the abutting owner.Payment of said sum shall be a condition precedent of this ordinance becoming effective. Section 4.This ordinance and the vacation of the street referred to herein shall become effective five (5)days after the payment of the above-referenced sum and the publication of this ordinance and the recording of a certified copy of the same in the records of the Snohomish County Auditor. __PA!)SED by me City Council "lid approved by the May is Q,~ay of ----"'~""'__---=------'-,2005.
