AN ORDINANCE OF THE OTY OF MARYSVILLE VACATING A PORTION
OF UNIMPROVED RIGHT-OF·WAY EAST OF 83P.D AVENUE NE AND
NORTH OF ASSESSOR'S TAX PARCEL NUMBER 30052500200500.
WHEREAS, a public hearing was held before Ma~ville GtyCouncil on Apri124, 2006 to
consider the vacation of a ponion unimproved right-of-way located east of 83 111 Avenue NE and
noM of .Assessor's Tax Parcel Nwnber 30052500200500 in the Gty of 1v1arysville, as legally
described in Exhibit A and as depicted in Exhibit B attached hereto; and
WHEREAS, the Marysville GtyGJuncil considered the evidence presented at the public
hearing and entered the following findings of fact:
(a) The :above-described right-of-way has remained unopened since it was originally acquired by
Snohomish. G)lJnryand subsequently the Gty, and serves no public pwpose;
(b) The righ.t·of.wayvacation shall not adve~ely affect the street pattern or circubtion of the
iuunediate area or the communityas a whole;
(c) The public need shall not be adve~elya£feeted by the vacation because provisions for road
connections have been made within the surrounding developments currently Wlder review and
constructionj
(d) The right-of-way is not contemplated or needed for future public usej
(e) No abutting owner 'Will become landlocked nor will access to any abutting properties be
substantially impaired;
(g) The petitioners are willing to purchase said right-of-way from we Ory at :a total cost of
$18,176.00 representing 100% of the assessed valuation of the samej
NOW, lHEREFORE, 1HE OTY ffiUNOL OF 1HE QTY OF MARYSVIil.E,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. That ponion of right-of-way, as legally described in Exhibit A and as depicted on
Exhibit B attached hereto, is hereby vacated, subject to the following conditions:
1. The portion of the subject right-of-way needed for future road connections between the
Berrywoods subdivision and the Rock Geek North Division 2 subdivision shall be dedicated to me Oty of Marysville at time of final plat recording of Rock Creek Nonh Division 2.
Section 2. In consideration for the vacation of said street, the Gty shall be paid the total
swn of $18,176.00 for the propenycoDveyed to the abutting owner. Payment of said sum
shall be a condition precedent of this ordinance becoming effective.
Section 3. 1his ordinance and the vacation of the right-of-way referred to herein shall
become effective five (5) days after the payment of the above-referenced sum and the
publication of this ordinance and recording by the Gty of a certified copy of the same in the
records of the Snohomish CoWlty Auditor.

Section 4. Severability. If any section, subsection, sentence, clause. phrase or work of this
ordinance should be held to be invalid or wlConstitutiooal by a court of competent
jurisdiction, such invalidity or Wlconstitutionality thereof shall not affect the validity or
constitutionality of any other section, subsection, sentence, clause, phrase or word of this
ordinance.
