WHEREAS, the CityCouncil of the City of Marysville finds that from time to time it is necessary and appropriate to reviewand revise provisions of the City's Zoning Code (Title 19 MMC);and WHEREAS, the Comprehensive Plan identifies publicuse properties within the City;and WHEREAS, the Marysville MunicipalCode establishesa public/institutional zone; and WHEREAS, the Planning Commission discussed the above-referenced amendments during a public meeting on March 14, 2006;and WHEREAS, after providing notice to the public asrequired by law,on May9,2006, the Marysville Planning Commission held a Public Hearing on proposed changes to the City'szoning code; and WHEREAS, at a public meeting on June 12, 2006,the Marysville CityCouncil reviewedand considered the amendments to the zoning code proposed by the Maryville Planning Commission; and NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1: MMCSection 19.04.020is hereby amended to read as follows: MAP SYMBOL RU (2.3-acre) R (basedensity in dwellings per acre) NB CB Rural Use Residential 19.04.020 Zones and map designations established. Section 9: MMC Section 19.14.020(1) is hereby amended to read as follows: 19.14.020 Applicability and interpretations. (1)Applicability. ORDINANCE-PI'ZONE C:\DOCUMENTS AND SElTINGS\SROBERGE\My DOCUMENTS\PJ ZONE\ORD PI ZONE 052306.DOC ----., .._..__.__._--------' 80F9 ·,,: (a)These design standards apply to all new institutional,commercial and residential development within the following zones:public/institutional (P/1), general commercial (GC), community business (CB),neighbothood business (NB),downtown commercial (DC), mixed use (MU),high density multiple-family (R-28),medium density multiple-family (R-18), low density multiple-family (R-12),high density single-family,smalllot (R-8). (b)The following activitiesshall be exempt from these standards: (i)Individual building permits for single-family residences, duplexes, and accessory uses, which are subject to the building design standards in MMC 19.08.030(2)(16),19.14.095, and 19.14.210; (ii)Construction activitieswhich do not require a building permit; (iii)Interior remodels of existing structures; (iv)Modifications or additions to existing multifamily, commercial, industrial, office and public properties when the modification or addition: (A)Constitutes less than 10 percent of the existing horizontal square footage of the use or structure;and (B)Constitutes less than 10 percent of the existingbuilding's exterior facade. (c)These standards are intended to supplement the zoning standards in the Marysville Municipal Code.Where these standards and the zoning ordinance standards conflict, the city shall determine which regulation applies based on which is more in the public interest and more consistent with the comprehensive plan. Section 10: MMC Section 19.14.050(1)is hereby amended to read as follows: 19.14.050 Site and building design standards. (1)Applicability. (a)Prior to submitting a building permit application, all development to which these standards apply shall be required to submit a site plan addressing the standards III this section for administrative review and approval by the community development director. (b)The site and building design standards of this section apply to institutional, commercial and multiple-family developments, whereas only subsections (2)and (3)of this section apply to single- familyand condominium developments. Section 11: MMC Section 19.14.100(1)is hereby amended to read as follows: 19.14.100 On-site recreation -Space required. Severability.If any section,subsection,sentence,clause,phrase or work of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section,subsection,sentence, clause, phrase or word of this ordinance.
