AN ORDINANCE OF THE CITY OF MARYSVILLE
APPROVING CLEARWIRE US LLC'S ACCEPTANCE OF
THE CITY'S GRANT OF A WIRELESS
COMMUNICATION FACILITY FRANCHISE AND
EXTENDING THE 30 DAY DEADLINE FOR SUBMISSION
OF SAID ACCEPTANCE.
WHEREAS,on November 13,2006,the City Council adopted Ordinance No.
2675,which granted Clearwire US LLC a wireless communication facility franchise and
which provided that said franchise must be unconditionally accepted by Clearwire within
30 days, unless the City Council adopts an ordinance granting an extension ofsaid
deadline; and
WHEREAS, Clearwire US LLC has submitted the required acceptance form, but
the 30 day acceptance period has expired;and
WHEREAS,it is in the public interest for the City to extend the 30 day
acceptance period;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE
DO ORDAIN AS FOLLOWS:
Section I.Extension ofFranchise Acceptance Period. The submittal by Clearwire US
LLC ofits wireless communication facility franchise acceptance form and related
documents and fees is hereby acknowledged and approved, and the 30 day period for
submission ofsaid acceptance is hereby extended accordingly.
Section 2. Effective Date. This ordinance shall become effective five (5) days after
publication.
