CL &Io(l.,<-<- AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON PROVIDING FOR THE AMENDMENT OF THE CITY'S COMPREHENSIVE PLAN BY THE ADOPTION OF THE MARYSVILLE,LAKEWOOD AND LAKE STEVENS SCHOOL DISTRICT 2006-2011 CAPITAL FACILITIES PLANS AS A SUBELEMENT OF THE CITY'S COMPREHENSIVE PLAN AND ESTABLISHING THE ADOPTION OF SAID PLAN AND THE COLLECTION AND IMPOSITION OF SCHOOL IMPACT FEES AS A COMPONENT OF THE CITY'S ANNUAL BUDGETING PROCESS;AND AMENDING ORDINANCE NO.2676 RELATING TO ADOPTION OF THE CITY BUDGET OF THE CITY OF MARYSVILLE. WHEREAS,the State ofWashington enacted the Growth Management Act ('GMA")in 1990 amending Chapter 82.02 RCW to authorize the collection ofschool impact fees on new development under specified conditions,including the adoption by the City of a GMA Comprehensive Plan as defined in RCW 36.70A; and WHEREAS,the MarysvilleCity Council adopted a GMA Comprehensive Plan on April 1, 1996 that included a policy commitment to consider the adoption ofa GMA-based scbool impact fee program (policy 10.S.6);and WHEREAS,in April 2005 the MarysvilleCity Council approved Ordinance No. 2569, adopting an update to the Comprehensive Plan that adopted the Lakewood and Lake Stevens 2004- 2009 Capital Facilities Plans as a Subelement to the City Comprehensive Plan; and WHEREAS,on November 28, 2005 the MarysvilleCity Council approved Ordinance No. 2605,adopting an update to the Comprehensive Plan that adopted the Marysville2005-2010 Capital Facilities Plan as a Subelement to the City Comprehensive Plan; and WHEREAS,City staff has reviewed the respective capital facilityplans developed by the Marysville,Lakewood,and Lake Stevens School Districts and adopted by their Board ofDirectors in accordance with the requirements of RCW 36.70A and RCW 82.02.050, et seq. and has determined that the plans meet the requirements ofsaid statutes and the MarysvilleMunicipal Code Tide 18C; and WHEREAS,the City ofMarysville has adopted MMC Chapter 18C relating to School Impact Fees and Mitigation which is designed to meet the conditions for impact fee programs in RCW 82.02.050,et seq; and WHEREAS,the Marysville Planning Commission held a public hearings on the 2006-2011 Capital Facilities Plans ofeach School District onJanuary 9, 2007; and WHEREAS,the Marysville,Lakewood and Lake Stevens School District have prepared an environmental checklist and issued a determination ofnonsignificance relating to their respective capital facilities plans; and WHEREAS,the Marysville,Lakewood and Lake Stevens School District Board of Directors have each adopted their respective Capital Facilities Plan; and ORDINANCE School CFP's 2006-2011 1 OF 3 -- -----------------------------------•• WHEREAS,the Marysville City Council has considered the recommendation ofstaff and the Planning Commission;and WHEREAS,the City Council has considered the School District's plan in the context of the adopted comprehensive plan,and the 2007 annual budget.Adoption ofthe District's Capital Facilities Plan and this ordinance are hereby incorporated as an amendment to the 2007 City budget as set forth in Ordinance No. 2676. NOW,THEREFORE,THE CI1Y COUNCIL OF THE CI1Y OF MARYSVIU"E, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1:Adoption.The Marysville School District Capital Facilities Plan 2006-2011, the Lakewood School District Capital Facilities Plan 2006-2011, and the Lake Stevens School District Capital Facilities Plan 2006-2011, are hereby incorporated by this reference and are hereby adopted as a subelement to the capital facilities element of the City of MarysvilleComprehensive Plan.The Plans hereby adopted replace the school district capital facilityplans previously adopted by the MarysvilleCity Council in Ordinances 2605 and 24Q9. Section 2: Schedule of fees.The Department ofCommunity Development is hereby directed to develop a schedule ofschool impact fees based upon the school district's Capital FacilitiesPlans hereby adopted and as adjusted by the provisions ofChapter 18C.10 of the MarysvilleMunicipal Code. Section 3:Budget Amendment.Ordinance No. 2676 relating to the 2007 budget is hereby amended hy adding a new section which shall read as follows: Itis anticipated that during calendar years 2007 through 2009 the MarysvilleCity Council will adopt certain capital facilities plans as a subelement ofthe City's Comprehensive Plan.The City Council finds that the adoption of said plans do have an effect on the City budget and in the case ofSchool Districts,the budget ofsuch districts for which the City is authorized to impose and collect fees intended to mitigate the impacts ofnew development.The City Council further finds that the administration and implementation ofcapital facilities plans does require City manpower and resources and as such, the adoption ofsaid plans should be considered as part of the annual budget process for said years. Section 4:Effective date. This Ordinance shall be effective five days following adoption and publication. Section 5: Savings Clause.Ifany section,subsection,sentence,clause,phrase or word ofthis Ordinance should be held to be invalid or unconstitutional by a Court ofcompetent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality ofany other section,subsection,sentence,clause,phrase or word of this Ordinance.
