The state traffic laws regulating the speed ofvehicles shall be applicable upon ,111 streets within this city,except as this chapter,as authorized by state 1<1\"..,declares and determines upon the basis ofengineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain areas, in which event it is unlawful for any person to drive a vehicle at a speed in excess of any speed so declared in this chapter when signs are in place giving notice thereof 11.04.037 Speed limit decreases and Increases -Author-ized. A.Whenever the Marysville public works director or his designutec determines on the basis of an engineering and traffic investigation that the rnax irnum speed l-imits permitted by luw upon the public "trcct",'-0·,1<'"",.'.~\ley"of thc city arc greater 'or less than is reasonable and safe under the conditions found to exist upon a public street,road or alley,the public works director or his ORDINANCE - I u,,'"14-2 ----_.~-_._~~-----~----~~---~._~--~.._-.-._~~-.__._--_.~ designated subordinate may determine and declare a reasonable and safe maximum speed limit thereon which may: I.Decreases the limit at intersections;or 2.Increases the limit but not to morc than sixty miles per hour;or 3.Decreases the limit but not to less than twenty miles per hour. 13.Any decreased or increased speed limit as authorized by subsection A of this section shall be effective when appropriate signs giving notice thereof are erected.Such maximum speed limit may be declared to be effective at all times or at such times as are indicated upon such sign;and differing limits may be established for different times of the day,different types of vehicles,varying weather conditions,and other factors bearing on safe speeds,which shall be effective when posted upon appropriate fixed or variable signs. 11.04.038 Change of existing speed limits -When effective. Speed limits in effect on the date of the adoption of this chapter shall remain in effect until the director of public works shall change speed limits under the provisions of this chapter or when the Marysville City Council shall,by ordinance,institute speed limit changes and when such changes,in either case,are posted.Any new speed limit will become effective upon posting consistent with the Manual on Uniform Traffic Control Devices (MUTCD)for streets and highways as adopted hy WSDOT.No speed limit change is effective until posted. Section 2.If any section,subsection,sentence,clause,phrase or word of this ordinance should be held to be invalid or unconstitutional by a court ofcompetent jurisdiction,such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality ofany'other section,subsection,sentence,clause,phrase or word ofthis ordinance. ...<'PASSED hy the City Council and APPROVED by the Mayor thisZ_2__day of )tJ 'J-",.2007.
