WHEREAS, the State legislature enacted RCW 9A.56.063 MAKING OR POSSESSING MOTOR VEHICLE THEFT TOOLS in 2007 and the City of Marysville desires to incorporate RCW 9A.56.063 by reference into the Marysville Municipal Code; now therefore, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1 Chapter 6.42 THEFT Sections: MMC Chapter 6.42 THEFT is amended to read as follows: Theft in the third degree. Definitions. Theft -Definition,defense. Unlawful issuance ofchecks or drafts. Making or possessing motor vehicle theft tools Possessing stolen property in the third degree. Obscuring identity of a machine. Theft ofsubscription television services. 6.42.010 Statutes incorporated by reference. 6.42.010 Statutes incorporated by reference. The following statutes regarding theft are incorporated by reference: RCW 9A.56.010 9A.56.020 9A.56.050 (I) 9A.56.060 (I),(3) 9A.56.063 9A.56.170 9A.56.180 9A.56.220 ORDINANCE - 1 of2 glmv/ord.Theft.Chapter6.42amend final 9A.56.230 Unlawful sale of subscription television services. 9A.56.240 Forfeiture and disposal of device used to commit violation. 9A.56.260 Connection ofchannel converter. 9A.56.270 Shopping cart theft. (Ord. 1451, 1986; Ord 965 § 9.01, 1977). Section 2 Except as provided herein, all other provisions and amendments ofthe Marysville Municipal Code as adopted by Ordinance No. 1451 and No. 956 shall remain in full force and effect, unchanged. Section 3. Severability. The provisions ofthis ordinance are declared to be separate and severable. The invalidity ofany clause, sentence, paragraph,subdivision,section or portion ofthis ordinance, or the invalidity ofthe application thereof to any person or circumstance,shall not affect the validity ofthe remainder ofthis ordinance, or the validity of its application to other persons or circumstances.
