AN ORDINANCE OF THE CITY OF MARYSVILLE AFFIRMING THE
DECISION OF THE HEARING EXAMINER AND REZONING
APPROXIMATELY 4.63-ACRES,INCLUDING THE SUBDIVISION KNOWN AS
SERENADE AND THE PARCEL ABUTTING THE NORTHEAST PORTION
OF SAID SUBDIVISION,AMENDING THE OFFICIAL ZONING MAP OF
THE CITY
WHEREAS,Seattle Pacific Homes owns the subdivision known as Serenade and Larry
Jones owns an approximately 0.68-acre parcel abutting the northeast portion ofsaid subdivision,
generally located at 6140 70'h Street NE,said properties being legally described in Exhibit A
attached hereto;and
WHEREAS,Larry Jones and Seattle Pacific Homes submitted an application to the City of

WHEREAS,the City of Marysville HearingFxarruncr held a public heatJng on said rezone

WHEREAS,the Marysville City Council held a public meeting on said rezone on April 28,
2008 and concurred with the Findings,Conclusions and Recommendation of the Hearing Examiner;
NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
oRDAIN AS FOLLOWS:
Section 1,Thej"itidin$s,Conclusions and Recommendation of the Hearing Examiner,with
teSp"(:lIP theabovereferenced.rezone,are hereby adopted by this reference and are approved,and
rhepr.operty described in ):'.:xhibitA is hereby rezoned from R45 (single-family,medium density)10 R-6.5

SectIOn 2.The zoning classification for the property described in Exhibit A shall be
perpetually conditioned upon strict compliance WIth each of the condiuons set forth 1Il the Findings,
Conclusions and Recommendation of the Heanng Exa111lner.VIOlation of any of the condiuons of

SectIon 3.The official zOnIng map of the CIty of Marysville IShereby amended to .reflect the
reclassification of the property described in Exhibit A
Section 4. This decision shall be final and conclusivcwrth the ng-bloCappeal by any
aggneved party ro Superior Court of Snohomish County by fUIlJg a Land Use Petinon pursuant to
the Land Use Petition Act withintwenty-one (21)days after passag~ofthi$ordinance.
Section 5.Severability.Ifany section,subsection,sentence,clause,phrase or work of this
ordinance should be held to be invalid or unconstitutional by a court ofcompetent jurisdiction,such
invalidity or unconstitutionality thereofshall not affect the validity or constitutionality ofany other
