ORDINANCE NO. 32. ~ \
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON, RELATING TO CIVIL SERVICE AND AMENDING
SECTIONS 2.16.040 AND 2.48.030 OF THE MUNICIPAL CODE.
WHEREAS, the City Council has determined to increase the number of community
service officers to enhance public safety and free patrol officers for other duties; and
WHEREAS, the municipal code defines which positions within the police department are
covered by the civil service system; and
WHEREAS, the City Council intends that community service officers be covered by the
civil service system; and
WHEREAS, two sections of the municipal code -2.16.040 and 2.48.030 -address the
positions covered by the civil service; and
WHEREAS, these sections contain outdated language that does not reflect the positions
that should be included or excluded from the civil service; and
WHEREAS, the code should be amended to properly reflect which positions in the police
department are covered by the civil service.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION 1. Section 2.16.040 of the municipal code is amended as set forth in Exhibit
A.
SECTION 2. Section 2.48.030 of the municipal code is amended as set forth in Exhibit
B.
SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or word of
this ordinance should be held to be invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or
constitutionality of any other section, subsection, sentence, clause, phrase or word of this
ordinance.
SECTION 4. Upon approval by the city attorney, the city clerk or the code reviser are
authorized to make necessary corrections to this ordinance, including scrivener's errors or
clerical mistakes; references to other local, state, or federal laws, rules, or regulations; or
numbering or referencing of ordinances or their sections and subsections.
SECTION 5. Effective Date. This ordinance shall become effective five days after the
date of its publication by summary.

2.16.040 Eligibility for participation in civil service system.
All full-paid, uniformed and commissioned employees of the police department, including
custody officers, animal control officers and parking community service officers, but excluding
the chief of police, assistant chief of police, analysts, code enforcement officers, and clerical
employees, mechanics and community service officers, shall be included in the classified civil
service and shall be participants in the civil service system; provided, that such employees must
first successfully qualify for permanent employment to a classified position. An empioyee on
disability leave shall remain subject to the civil service system until such time as he or she
receives disability retirement and reaches the age of 50.

2.48.030 Classified personnel.
All full-paid, uniformed and commissioned employees of the police department, including
custody officers, animal control officers and parking community service officers, but excluding
the chief of police, assistant chief of police, managers, analysts, code enforcement officers, and
clerical employees, mechanics and community service officers, shall be in the classified service,
and under the jurisdiction of the civil service commission; provided, that this shall not apply to
probationary employees.
