WHEREAS,a petition for the formation of a Utility Local Iinpr ovemerrt District commonly known as Midway (sewers)has been filed.with'the City Council of the City of Marysville pursuant to _RC~j35.43,.q~2 and 35.43.,120~;~aid Utility Lo~al Improvement District tOI De compr i sed of the t err i.tor y below-descn.bed for the purpose of constructing ,a sewer main and appurtenances to serve said territory; and WHEREAS,~he ~e~rltorial extent of the proposed improve- ment,all of which is 'situated in Snohomish County,Washington,is within the boundaries described in "Exhibit A",which is attached hereto and incorporated herein by this reference;and • 'L' i WHEREAS,the proposed mode of payment for said improve- ment is by such funds,grants,allotments and payments which may be received from the United States or any public body or any public or private sewer user not within the territory of the proposed district, and the difference is to be paid by assessments on the property within said district pursuant to the provisions of RCW 35.44.030 and 35.44.047.Said assessments shall be for the sole purpose of pay- ment into such Revenue Bond Fund as may be specified by the City of Marysville for the payment of revenue bonds issued to defray the cost of such system and facilities,or any portion thereof.Said payments shall include all costs and expenses incurred by the City, including but not limited to,engineering costs,attorney's fees, costs of publication and mailing notices,even in the event the district is not formed for any reason;and WHEREAS,the City of Marysville should hold a hearing on the acceptance of the petition as well as a hearing on the assess- ment roll therefor;Now,Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYS- VILLE,WASHINGTON AS FOLLOWS: Section 1.The City of Marysville hereby declares its intent to accept the petition aforedescribed and form a Utility Local Improvement District commonly known as Midway (sewers)Utility Local ITI~rovement District. -1- ~t. • Section 2.That a hearing will be held before the City Council of the Clty of Marysville for the purpose of accepting the 'tion and the formation of the district on the liLt day of ,1977 at 8:00 p.m.at City Hall.Notice thereof shall be~g~~~~n~accordance with RCW 35.43.150,et seq.,setting forth the proposed improvement,the estimated costs and the estimated bene- fits of the particular lot,tract or parcel,and such notice shall be given to the persons and in the manner as provided by law.
