A Resolution of the City of Marysville relating to
the use of Federal Drought Relief Funds,declaring
an emergency,and authorizing construction contracts
without bids.
WHEREAS,the City of Marysville and surrounding areas
are presently suffering from a drought severely reducing sources for
the Marysville public water supply system;and
WHEREAS,on August 11,1977 the,Sunnyside Well serving
said water system went dry,causing an emergency water shortage for
said system which jeopardized public health,safety and welfare;and
WHEREAS,said emergency could not have been anticipated,
and there is now an immediate need for a new water source to be
developed and activated without the delay normally involved in public
works projects of this magnitude;and
WHEREAS,the Economic Development Administration of the
United States Department of Commerce has indicated the availability
of federal funds through the Community Emergency Drought Relief Act
of 1977,provided said funds can be immediately used by the City
to meet the aforesaid emergency;Now,Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON AS FOLLOWS:
Section 1.The Mayor,or his designee,is hereby author-
ized to take all;steps necessary to apply for federal funds through
the Community Emergency Drought Relief Act of 1977,and to use said
funds for the:.development of a new water source at the Stillaguamish
River;the construction of a ranney collector,and the necessary pumps,
tran~mission.lines and other appurtenances;the reconstruction and
repair ,of the Sunnyside Well and appurtenances;and the construction
of water conservation improvements in,City parks and buildings.

Attorney and the City Engineer are hereby authorized to negotiate
contracts for construction of the above-described projects,and
upon finding the:'said con t-r ac t s are in the best interest of the City.
the Mayor is authorized to execute the same without further Council
review or approval.By this authorization,the Council is specifically
waiving the r equ i-r emen t that the 'above-described projects be submitted
for public bid pursuant to RCW 35:23.352.This waiver is based
upon a finding that an emergency exists,jeopardizing the public
health,safety and welfare of all persons using the Marysville water
system;it is further based upon the requirement of the Economic
Development Administration that federal drought relief funds be
immediately used without the delay involved in meeting the requirements
of the bid statute of the State of Washington.

Section 3.The Mayor,or his designee,is hereby author-
ized to execute such agreements as are reasonably necessary to acquire
easements for transmission lines and other appurtenances which are
part of the proposed Stillaguamish water works.Said agreements may
include an obligation of the City of Marysville to pay a reasonable
price for said easements.

Attorney are hereby authorized to commence preliminary procedures for
the issuance of revenue bonds in an approximate amount of $'00,000,
representing the City's share of the cost of the above-described
