CITY OF MARYSVILLE,HASHINGTON RESOLUTION NO.B88 A RESOLUTION of the City Council of the City of Marysville,Washington,declaring its intention to initiate the formation of Utility Local Improvement District No. 7 to carry out the system or plan of additions to and betterments and extensions of the waterworks utility of the City,including the system of sewerage as a part thereof,as adopted by Ordinance No.q Rd-to serve the LaJoy area outside the corporate oowruTaries of the City,all as applicable to such utility local improvement district;and fixing the date,time and place for a public hearing on the formation of the proposed utility local improvement district. WHEREAS,the City of Marysville,~Iashington (hereinafter called the "City"),by Ordinance No.385 passed September 2,1952, combined the sewerage system of the City and all additions and improvements thereto with the waterworks utility of the City,and the sewerage system at all times since has been considered a part of and belonging to the waterworks utility of the City,and the words "waterworks utility of the City"shall hereinafter mean the combined sewerage system and water system of the City,together with all additions thereto and betterments and extensions thereof hereafter made;and WHEREAS,pursuant to Ordinance No.~~OL passed March 13, 1978,the City Council specified and adopted a system or plan of additions to and betterments and extensions of the waterworks utility of the City and provided the method of financing the same from the issuance and sale of water and sewer revenue bonds in the principal sum of approximately $1,360,000,such bonds to be supported by assessments to be levied in one or more utility local improvement districts therein authorized to be created;and WHEREAS,the City Council has determined it to be in the best interests of the City that such system or plan of additions to and betterments and extensions of the waterworks utility of the City be undertaken and that a utility local improvement district be formed within the area hereinafter more particularly described to secure water and sewer revenue bonds to be issued to finance the cost of carrying out such system or plan of additions to and betterments and extensions of the waterworks utility of the City; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,as follows: Section 1.It is the intention of the City Council of the City to order the acquisition and construction of the system or plan of additions and betterments and extensions of the water- works utility of the City as adopted in Ordinance No.~9t passed by the City Council and approved by the Mayor on March 13,1978, to serve the LaJoy area outside the corporate boundaries of the City and applicable to the proposed utility local improvement district hereinafter described.The nature and territorial extent of such proposed improvement consists of the construction and installation of sewer mains as more particularly described in Exhibit "A"attached hereto and by this reference made a part hereof,together with all necessary appurtenances. Section 2.To carry out the foregoing system or plan of additions to and betterments and extensions of the waterworks -2- ~---------------~~ utility of the City,there shall be formed an utility local improve- ment district to be known and designated as "Utility Local Improvement District No. 7 of the City of Marysville,Washington," the boundaries of which are described in Exhibit "B"attached hereto and by this reference made a part hereof. Section 3.The estimated cost and expense of the system or plan of additions to and betterments and extensions of the waterworks utility of the City is hereby declared to be $1,360,000.00, all of which shall be borne by and assessed against the property included within proposed utility Local Improvement District No.7, all being the property specially benefited by such improvement. The assessments in said utility local improvement district shall be for the sole purpose of payment into the "Water and Sewer Revenue Refunding Bond Fund,1977,"in the event that the water and sewer revenue bonds authorized to be issued by Ordinance No.~ shall be issued on a parity of lien with the outstanding "Water and Sewer Revenue Refunding Bonds,1977,"and payable out of such fund in accordance with the provisions of Ordinance No. 967 of the City;otherwise,such assessments shall be for the sole purpose of payment into a special bond redemption fund to be hereafter created for the payment of water and sewer revenue bonds to be hereafter issued by the City to provide the funds required to pay the cost and expense of carrying out such system or plan. Section 4.A public hearing on the formation of Utility Local Improvement District No. 7 shall be held in the Council t..i"~JChambersintheCity~,Marysville,Washington,at 8:00 o'clock p s m, (PST)on __-L~~~__~~~'1978,at a regular meeting of the City Council then to be held at such time and place. -3- .' All persons who may desire to object to the improvement and to the formation of the proposed utility local improvement district are hereby notified to appear and present their objections at the hearing and meeting of the City Council to be held at such time and place. Section 5.Larry R. Wade of Hammond,Collier & Wade - Livingstone Associates,Inc.,the City's consulting engineers,is hereby directed to submit to the City Council on or prior to by law to be submitted. The foregoing resolution was ADOPTED by the City Council of the City of Marysville,Washington,at an open public regular meeting thereof,this 13th day of March,1978.
