A Resolution of the City of1Marysville stating
its intent to vacate an alley,
WHEREAS,P and S Investment·Company,a partnership,has
petitioned the City of Marysville for the vacation of the following-
described 'portion of a public alley located between Delta Avenue and
Cedar Avenue,Block 1,Plat of Marysville,recorded in Volume 298
of Deeds,page 78,Records of Snohomish County,Washington:
The point where the northerly line of
Lot 8 of Block 1,Plat of Marysville recorded
in Volume 298 of Deeds,at page 78,Records of
Snohomish County,Washington,intersects the
easterly boundary of the railroad right-of-way
shall be the true point of beginning;thence
easterly to the northeast corner of Lot 9 of
the aforementioned block,and thence northerly
to the southeastern corner of Lot 4 of the afore-
mentioned block,thence westerly to the point
where the southerly line of Lot 5 of the afore-
mentioned block intersects with the easterly
boundary of the railroad right-of-way,and
thence south to the true point of beginning;
located in the City of Marysville,County of
Snohomish,State of Washington.
and;
WHEREAS,the City Council of the City of Marysville held a
public hearing on said petition on July 23,1979 pursuant to Chapter
12.32 of the Marysville Municipal Code,and based upon the evidence
adduced at said hearing,hereby enters the following findings of
fact:
A.If the existing buildings to the north of the subject
alley are demolished,restored or refurbished,the vacation of
the subject alley would provide a public benefit by encouraging
attractive and useful improvement of the abutting property;
B, The vacation of the subject alley would not adversely
affect the street pattern or circulation of the immediate area
or the community as a whole;
C,Vacation of the subject alley would not adversely
affect the public need;
D. The public alley lS not contemplated or needed for
future public use.

No abutting owner will become landlocked or its access
be substantially impaired by the vacation of the subject

F. The fair market value of the subject alley is $1200.00,
as determined by John H.Netzley,SRPA.The petitioner should
be required to pay the City one-half of said amount,or $600.00.
G.The petitioner should be required to fence the east
end of the vacated portion of the alley,thereby segregating
it from the remaining public portion of the alley.
Now,Therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The City Council of the City of Marysville hereby states
its intent to vacate the above-described portion of a public alley
situated between Delta Street and Cedar Street,Block 1,Plat of
Marysville,thereby vesting title to the same in the abutting owners
to the north and south,to-wit:P and S Investment Company,a
partnership,subject to the following conditions precedent:
A. The petitioners have paid the City $600.00,
receipt of which is hereby acknowledged.
B.Petitioners or their successors or assigns shall
apply for a permit or permits to demolish,restore or
refurbish the existing structures located north of

C. The petitioners or their successors or assigns
shall demolish,restore or refurbish the existing
structures located north of the subject alley and
submit plans to the City for the commercial use of
the JSUbject property within three years of the date
of vI,?I,niO .
2.The fulfillment of t he conditions precedent shall
nlake this a binding resolution on the part of th~City Council,and
the Council shall immediately thereafter vacate the subject alley by
ordinance subject to the condition that the petitioner,or its
successors or assigns,shall construct a fence across the east end
of the vacated portion of the alley.

3.The failure of,the petitioner,or its successors or

paragraph 1 above,including the time limit specified therein,shall
