A Resolution of the City of Marysville granting a
variance for utility connections to a certain'
residential development in violation of the City's
Comprehensive Plan.
WHEREAS,John Harrison is the owner of 7.95 acres located
north of the Marysville city limits on the east side of 55th Avenue
N.E.and immediately north of 92nd Place N.E.,said property being
developed under the name of Piecon Estates,Snohomish County Sub-
Division No.Pl(1-79);and
WHEREAS,the development of said property proposes 31 lots
with an average lot size of 7,560 square feet;and
•WHEREAS,the 1978 Comprehensive Plan for the City of
Marysville,as amended on a interim basis by Resolution 929,passed
by the Ci ty Council on Apri 1 23,1979"des i gna tes the sub j ect property
in the Residential 9600 classification;and..

WHEREAS,John Harrison applied,forla variance,and a public

THE CITY COUNCIL OF THE CITY OF MMYSVILLE,WASHINGTON
HEREBY ENTERS THE FOLLOWING FINDING~'O(FACT.:I~I",f r.,
1.The City's Comprehensive Plan originally designated
the subject property in the Residential 7200 classification.
This was amended on an interim basis by Resolution 929 adopted
on April 23,1979.
2. The preliminary plat of Piecon Estates was presented
to Snohomish County at a public hearing held on April 10,1979.
It proposed lot sizes of 7560 square feet.A representative
of the City of Marysville attended said public hearing and
stated that the proposal was consistent with the Comprehensive
Plan and the plat would be eligibile for City utilities.In
reliance thereon,Snohomish County approved the preliminary
plat on April 30,1979.
3. A drainage problem on the s~bject property makes
development thereof unusually expenslve.Development with
lot sizes of 9600 square feet would be financially unfeasible.
4.The subjeet property is surrounded on all four sides
by residential development with 7200 square foot lot sizes.

Plan would cause a practical difficulty.and an~unnecessary,
hardship to the owner of the subject property,and will
deny said owner the beneficial use of the property.;'.I'

6.The circumstances justifying·a 'variance ,to the
City's Comprehensive Plan are unique to the subject
property and not generally shared by other.pT,operties in
the vicinity..'..'
7.The granting of a variance in this case would not
be detrimental to the public interest,welfare or the
environment,and would not be inconsistent with the long-
range plans of the Marysville Utility System.
BASED UPON THE FOREGOING FINDINGS OF FACT,THE CITY COUNCIL
.OF THE CITY OF MARYSVILLE,WASHINGTON HEREBY RESOLVES AS FOLLOWS:
Pursuant to Section 14.04.065 and 14.14.050 of the
Marysville Municipal Code,a variance is hereby granted for the
development of Piecon Estates with average lot sizes of 7560 square
feet.Water and sewer utilities of the City of Marysville shall be
made available for such development provided that all other applicable
codes and regulations are complied with.
