WHEREAS,the 1978 Comprehensive Plan for the City of Marysville,as amended on an interim basis by Resolution No.929, designates the subject property in the Agricultural Five-Acre Classification;and WHEREAS,the subject property is located outside of the utility service area of the City of Marysville;and WHEREAS,pursuant to Section 14.04.065 and 14.14.050 of the Marysville Municipal Code,and Ordinance No.1149,utility services must be denied to a development of this nature unless a variance is issued therefor;and WHEREAS,R.Merkel applied for a variance,and a public meeting was held thereon on February 23,1981 and March 9,1981: NOH,Therefore THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON HEREBY ENTERS THE FOLLOWING FINDINGS OF FACT: 1.The City's Comprehensive Plan,as amended on an interim basis by Resolution No.929,designates the subject property in the Agricultural Five-Acre Classification.The proposed development of lots 20,000 square feet in size is in violation of the Comprehensive Plan. 2.'By In terlocal Agreement wi.th Snohomish County dated February 5,1979,the City of Marysville agreed not to extend sewer service east of 51st Avenue N.E.or north of 108th Street N.E.This would exclude the subject property. 3.The subject property 1S located outside of the City's duly-adopted utility service area. 4.Snohomish County has not yet granted final approval to the proposed plat for the subject property. 5.Literal enforcement of the City's Comprehensive Plan RESOWT ION - 1 and the City's utility service area will not cause an unnecessary hardship to the owner of the subject property and will not deny said owner the beneficial use of his property. 6.There are no circumstances justifying a variance to the City's Comprehensive Plan and the City's utility service area which are unique to the subject property and which are not generally shared by other properties in the vicinity. 7. The granting of a variance in this case would be detrimental to the public interest and welfare,and would be inconsistent with the long-range plans of the Marysville Utility System. BASED UPON THE FOREGOING FINDINGS OF FACT,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON HEREBY RESOLVES AS FOLLOWS: Pursuant to Section 14.04.065 and 14.14.050 of the Marysville Municipal Code,and Ordinance No.1149,the variance application of R.Merkel is hereby denied,and City water and sewer utilities shall not be made available to the subject property. . .'I ~ .~cPASSED by the City'Council and APPROVED by the Mayor thIS;J -day of )')1111'1/'1 -',,1981..t.'"..j"\•\~'I •.I._:J'~..., THE'C ,OF MARYSVILLE·.r, ,,.~..~ I Approved as teo form: RESOLUTION -2
