WHEREAS,Gary Stanton and Jack Bartlett are the contract purchasers of tax lots 1-092 and 1-093 located at 7005 and 7015 47th Avenue N.E.,Marysville,Washington;and WHEREAS,said owners filed a petition with the City Clerk seeking a rezone of said property from the single-family residential classification to the multiple-family medium-density classification; and WHEREAS,the City Planning Commission held public hearings on said rezone on September 24,1980,December 10,1980 and January 14,1981 and submitted formal findings of fact and a recommendation in favor of granting said rezone,subject to a concomitant rezone con t r ac t;and WHEREAS,in response to appeals from aggrieved parties the City Council held a public hearing on said rezone on March 23,1981, and considered all testimony and exhibits presented at said hearing; Now,Therefore THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASIIINGTON HEREBY ENTERS THE FOLLOWING FINDINGS OF FACT: 1.The Marysville 1978 Comprehensive Plan designates the property in the mUltiple-family medium-density classification. However,this is a long-range plan which must be interpreted in the context of current land uses in the surrounding neighborhood,current housing needs,and current traffic hazards and street improvements. 2.Liberty Street (47th Street N.E.)is currently used as a by-pass for State Street,and has become a north-south arterial. The traffic on Liberty Street has not yet exceeded the physical capacity of said street,but has reached the limit where it is no longer compatible with the abutting residential uses. 3,The proposed project would add thirty-one dwelling units to this neighborhood,and the traffic generated by those units would have a significant adverse impact upon Liberty Street and the abutting uses as they are presently developed. 4.A concentration of mUltiple-family rental units within a single neighborhood contributes to adverse impacts on the human environment relating to noise and crime.The neighborhood in question has already reached'a point where these impacts are unacceptable to the remaining single-family residences.Mi t i.ga t i on measures must be proposed before any additional multiple-family dwelling units areapprovedinthisarea. S.Liberty Street,between the subject property and Grove Street,constitutes a serious hazard because of its lack of sidewalks, poor drainage,and parking problems created by the apartment units located at the intersection of said streets.These hazards must be mitigated before any additional development is approved. 6.the additional elementary school children which would live in the proposed project would create an unacceptable impact upon Liberty School which cannot be met under current financial circumstances. 7.There has been no demonstrated need for additional multiple-family housing in this area of the City of Marysville. 8.The granting of the requested rezone and the development of the subject project would be detrimental to the public health, safety and welfare,and contrary to the,be.s t interests of the current residents of the affected nei.ghbor hocd . ]~. ..-i f L Based upon the foregoing Firidl~g~of Fact,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHI,NGTON HEREBY RESOLVES AS FOLLOWS: .J !I The rezone of the above-described property from the single- family residential classification'.t o1the mu I t Ip l.e e f am i.Ly-medium- density classification is hereby DENIED without ~rej~dice to the right of the property owner to re-ap~ly fof said rkzone'ai s~ch time as the negative impacts referred to above may be mitigated.,.
