HomeMy WebLinkAboutR-1010 - Granting a variance for utility connections to a mobile home park development in violation of the city's comprehensive planCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESO LUTI ON NO.J ()J ()•.\\, A RESOLUTION OF THE CITY OF ~ffiRYSVILLE GRANTING A VARIANCE FOR UTILITY CONNECTIONS TO A MOBILE •,HOME P.ARKDEVELQPMENT IN-VIOLATION OF THE CITY'S COMPREHENSIVE 'PLAN • •':WHEREAS ,Sterling Financing and Investment Corp.is the owner of 33 acres located north of the Marysville City Limits on the east side of 40th Avenue N.E.at approximately l44th Street N.E., said property being proposed for a mobile home park known as Sterling Estates,Snohomish County Conditional Use Permit No.12-70;and WHEREAS,the proposed mobile home park would have approxi- mately 222 units,for a density of 6.7 units per acre;and WHEREAS,the 1978 Comprehensive Plan designates the subject property in the Residential 12,500 classification;and WHEREAS,pursuant to Sectiolli14.04.065 and 14.14.050 of the Marysville Municipal Code,utility services must be denied to a develop- ment which violates the Comprehensive Plan unless a variance is issued therefor ;and WHEREAS,Sterling Financing and Investment Corp.applied for a variance,and a public meeting was held thereon on May 11,1981; NOW,THEREFORE THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON, HEREBY ENTERS THE FOLLOWING FINDINGS OF FACT: 1.The subject property was proposed for a mobile home park in 1970,and approval of the same was granted by Snohomish County under Conditional Use Permit No.12-70.At that time City of Marysville utilities were available.Although the Conditional Use Permit has sub- sequently been revoked because of the developer's inactivity,extenuat- ing circumstances justify a finding of vested rights to City utility services. 2. The subject property is abutted to the east by a mobile home park with comparable density.Said mobile home park is connected to City utilities. Resolution -1 3.Development of the subject property in phases would lessen the immediate impact on the City's sewer facilities. 4.Development of the subject property as a mobile home park would be impossible without the availability of City sewers. 5.Literal enforcement of the City's Comprehensive Plan would cause a practical difficulty and an unnecessary hardship to the owner of the subject property,and would deny said owner the beneficial use of the property. 6. Comprehensive erally shared The circumstances justifying a variance to the City's Plan are unique to the subject property and not gen- by other properties in the vicinity. 7. The granting of a variance in this case would not be detrimental to the public interest,welfare or the environment,and 'would not be inconsistent with the long-range plans of the Marysville utility system. BASED UPON THE FOREGOING FINDINGS OF FACT,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,HEREBY RESOLVES AS FOLLOWS: Pursuant to Sections 14.04.065 and 14.14.050 of the Marysville Municipal Code,a variance is hereby granted for the development of Sterling Estates mobile home park for a maximum of 222 dwelling units on 33 acres.Water and sewer utilities of the City of Marysville shall be made available for such development on the following conditions: 1.The project must receive a valid Conditional Use Permit from Snohomish County which is consistent with the provisions of this resolution.. £~..';.,r The project must be phased over a period of not less ()o ;y than'18 months,with no more than one -thi rd of the total dwelling~'.~~uniti cdnnected to utilities at each six-month interval.
