CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO./02.h A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,FIXING THE DATE,TIME AND THE PLACE FOR A PUBLIC HEARING ON THE FORMATION OF A PROPOSED LOCAL IMPROVEMENT DISTRICT FOR THE PUR- POSE OF CONSTRUCTING SEWER MAINS AND APPURTENANCES TO SERVE CERTAIN TERRITORY OUTSIDE OF THE CITY LU1ITS. WHEREAS,a Petition for the formation of a Local Improvement Dis- trict has been filed with the City Council of the City of Marysville pursuant to RCW 35.43.120 to form a Local Improvement District com- prised of the territory described below for the purpose of constructing sewer mains and appurtenances to serve said territory,including mains and appurtenances to run from the present terminus of the City sewer system to the territory within the proposed district through territory not within the proposed district;and WHEREAS,the territorial extent of the proposed improvement is within the following described premises situated in Snohomish County, Washington: The plat of Pilchuck Park as recorded in Volume 26 of Plats on page 73,Records of Snohomish County, Washington,and legally described as follows: The Northwest quarter of the Northeast quarter of the Northwest quarter of Section 22,Township 30 N., Range 5 E, W.M.;LESS the South 170 feet:LESS the North 156 feet of the South 326 feet of the West 181.04 feet;also LESS the road;Snohomish County, Washington. WHEREAS,the nature and territorial extent of such proposed sewer system consists of the construction and installation of the following sewer mains together with all necessary appurtenances: A sewer line with stubs on 57th Avenue N.E.beginning on 9lst Place N.E.and extending south for approximately 200 feet. A sewer line with stubs on 56th Avenue N.E.beginning on 9lst Place N.E.and extending south for approximately 200 feet.. RESOLUTION -1 .' ", • •••• I # A sewer line with stubs on 91st Place N.E.beginning approximately 120 feet east of 57th Avenue N~E.and extending west approximately 650 feet.• All in the Plat of Pilchuck Park as recorded 'in Volume 26 of Plats on page 73,Records of Snohomish County, Wash ington. WHEREAS,the City Engineer has made an estimate of the cost and expense of the proposed improvements,and has created a preliminary assessment role which has been certified to the City Council.The entire cost of such improvements shall be borne by property within the proposed district,said district having no outstanding and unpaid local improvement assessments at the present time;and WHEREAS,the City Engineer has certified that the Petition is sufficient pursuant to RCW 35.43.120,and this matter is ready for public hearing;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ~~RYSVILLE, WASHINGTON,AS FOLLOWS: Section 1.A public hearing shall be held before the City Council of the CIty of Marysville for the purpose of considering the above- referenced Petition for the formation of a Local Improvement District for the construction of sewer improvements described above.Said public hearing shall be held on October 12,1981,at 8:00 p.m.at the City Council chambers in the Marysville City Library,4822 - 72nd Street N.E., Marysville,Washington.All persons who desire to object to the improve- ment and to the formation of the proposed Local Improvement District are hereby notified to appear and present their objections at the hearing of the City Council to be held at such time and place.At the hearing the City Council will consider the objections made and will correct,revise, raise,lower,change or modify the preliminary assessment role or any part thereof,and may at the conclusion thereof confirm the role (or the amended role)by Ordinance and create the Local Improvement District, or may reject the same. Section 2.All costs of preliminary engineering on the proposed Local Improvement District,and all costs of mailing and publishing Notices of the Public Hearing shall be borne by the property owners within the Local Improvement District;provided,that in the event that the Local Improvement District is rejected,those persons having signed the Petition shall bear all such costs. Section 3. The estimated cost of the proposed improvements is $38,000.00.Said cost,as adjusted after completion of the project, shall be assessed against all property within the district pursuant to the final assessment role adopted by the City Council.Said property RESOLUTION - 2 •j . \..,l owners shall be required to pay said assessments in installments over a term to be set by the City Council,said term not td~xceed ten years in length.Assessment payments shall be made to the ,Local Improvement District No. 61 fund.Said fund shall obtain interim financing for the construction of the sewer improvements by means of·a promisory note pur- chased by the Water/Sewer Reserve Sinking Fund of the City of Marysville.
