WHEREAS,Mountain View Presbyterian Church applied for a variance and a public meeting was held thereon on March 22,1982; NOW,THEREFORE, WHEREAS,said owner proposes to develop the three resi- dential lots by constructing a duplex on each of them;and WHEREAS,Mountain View Presbyterian Church is the owner of approximately 4.5 acres located at 5115 -100th Street N.E., Marysville,Washington.Said property is segregated into one large lot for church use,and three residential lots located at the north end.A legal description of the three residential lots is attached hereto as Exhibit A and incorporated herein by this reference;and WHEREAS,the 1978 Comprehensive Plan for the City of Marysville,as amended on an interim basis by Resolution No.929, designates the subject property in the residential 12,500 square foot classification,and would not allow duplexes on the lots in question;and WHEREAS,pursuant to Sections 14.04.065 and 14.14.050 of the Marysville Municipal Code,utility services must be denied to a development which violates the Comprehensive Plan unless a var- iance is issued therefor;and The City Council of the City of Marysville,Washington, hereby enters the following Findings of Fact: 2.Snohomish County zoning requirements would permit said duplexes to be built on lots with a minimum size of 10,800 square feet. • ,I \...1\, 3.The City's Comprehensive Plan requires a minimum lot size of 12,500 square feet for each dwelling unit,and would require 25,000 square:feet for.a'duplex.,.',, I • :4.The full development of the total property owned by the church (4.5 acres)would permit a development density of 12 dwell- ing ·units under the Marysville Comprehensive Plan.The applicant is willing to impose a restrictive covenant on said property limiting the ultimate development to a maximum of six dwelling units (or three duplexes). • . . 5.Abutting property has been recently approved for devel- opment of 89 multiple-family dwelling units.The proposal of the church is compatible with this abutting land use. 6.Literal enforcement of the City's Comprehensive Plan would cause an unnecessary hardship to the owner of the subject prop- erty. 7.The circumstances justifying a variance to the City's Comprehensive Plan are unique to the subject property and not gener- ally shared by other property owners in the vicinity. 8.The granting of a variance in this case would not be detrimental to the public interest,welfare or the environment,and would not be inconsistent with the long-range plans of the Marysville utility system. BASED UPON THE FOREGOING FINDINGS OF FACT,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,HEREBY RESOLVES AS FOLLOWS: Pursuant to Sections 14.04.065 and 14.14.050 of the Marys- ville Municipal Code,a variance is hereby granted for the develop- ment of lots 1,2 and 3,described in Exhibit A,with a duplex on each lot.Water and sewer utilities of the City of Marysville shall be made available for such development on the following conditions: a)The total property owned by Mountain View Presbyterian Church,consisting of approximately 4.5 acres,shall not be further subdivided. b)The total number of utility connections available for the 4.5 acres shall consist of those allowed for the church and those allowed for the three duplexes approved herein.There shall be no further utility connections allowed for any other purpose. c)The construction of the duplexes must comply with all applicable regulations of Snohomish County.
