RESOLUTION NO.1083-A
A RESOLUTION OF TIlE CITY OF MARYSVILLE PROPOSING A
PROJECT FOR THE CONSTRUCTION OF CURBS,GUTTERS AND
SIDEWALKS ON CERTAIN PUBLIC RIGHT-OF-WAY ON NINTH AND
TENTH STREETS N.E.AND ON COLUMBIA AVENUE,PROPOSING
THE IMPOSITION OF PART OF THE COST OF SUCH PROJECT ON
THE ABUTTING PROPERTY OWNERS,AND CALLING A PUBLIC HEARING
FOR FORMAL CONSIDERATION OF THIS PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON,AS FOLLOWS:
Section 1 Purpose.The City finds that it is in the public
interest to construct curb,gutter and sidewalk improvements at the same time
storm sewers are being installed in public right-of-way.Further,it is
in the public interest to do projects of this nature for an entire street at a
single time,rather than piecemeal.The City can assist in this regard by
coordinating isolated construction projects being conducted by private
developers,with large-scale projects initiated by the City pursuant to
Chapter 35.68 RCW.Further,the City is committed to using a portion of its
sales tax revenue for public funding of street and sidewalk improvements.
Section 2 Description of Improvements.The City proposes
construction of curbs,gutters and sidewalks on the following public streets:
The north 140 feet of the east side of Columbia
Avenue between Eighth Street and Ninth Street.
The east side of Columbia Avenue between Ninth
Street and Tenth Street.'
The north 140 feet of the west side of Columbia
Avenue between Eighth Street and Ninth Street.
The west side of Columbia Avenue between Ninth Street
and Ebey Arms Apartments.
The north side of Ninth Street for a distance of 70
feet west of Columbia Avenue.
The north side of Ninth Street for a distance of 220
feet east of Columbia Avenue.
The south side of Ninth Street between State Avenue
and Columbia Avenue.

The south side of Ninth Street for a distance of
50 feet east of Columbia Avenue.
The south side of Tenth Street for a distance of
220 feet east of Columbia Avenue.
Section 3 Construction Responsibility.The City shall assume
responsibility for hiring and supervising a contractor for the construction
of the above-described improvements,and for inspecting and approving the
completed project.The City may use its employees,equipment,supplies and
materials for any portions,or all,of the project,provided that the total
cost of the project is less than $20,000.00.
Section 4 project Schedule.Work on the above-described
improvements shall commence on or before April 1,1983 and shall be completed
on or before July 1,1983,weather permitting.
Section 5 Project Costs --Assessments.Fifty percent (50%)
of the total project costs shall be borne by the City.The remaining 50%of
the total project costs shall be borne by the abutting property owners,and
allocated on the basis of each lineal front foot of the property abutting
the improvement.Pursuant to RCW 35.68,the abutting property owners shall pay
their share over a three-year assessment period.The exact amount of each
property owner's assessment shall be specified in the final assessment roll
to be hereafter adopted by the City Council.
Provided,that pursuant to Section 12.02.170 of the MarySVille
Municipal Code,any person who develops property abutting the above-described
improvement between the date of this resolution and the termination of the
three-year assessment period,shall be required to pay,at the time of such
development,100%of the cost of curb,gutter and sidewalk improvements
abutting said property without the benefit of a 50%contribution from the
City.Credit shall be given for any assessments previously paid pursuant to
this resolution.
Section 6 Public Hearing.A public hearing on the above-
described improvements,and the proposal for financing the same,is hereby
scheduled for March 14,1983,at 8:00 p.m.,in the Marysville City Council
Chambers,4822 -72nd Street NE,Marysville,Washington.Notice of said public
hearing shall be mailed to the owner or reputed owner of all properties abutting
the proposed improvement,as their names and addresses may appear on the tax
rolls of the County Treasurer.At said hearing,the City Council shall hear
all persons who appear for or against the improvement,and determine whether
the City will or will not proceed with the improvement and whether the City
will make any changes in the original plan,and what such changes shall be.
ADOPTED by the City Council and APPROVED by the Mayor this
14th day of February,1983.
