A RESOLUTION OF THE CITY OF lffiRYSVILLE ACCEPTING
A PETITION FOR VACATION OF PUBLIC RIGHT-OF-WAY,
AND CALLING FOR A PUBLIC HEARING ON THE SN~E.
WHEREAS,on March 23,1983,Gary D.Carter and Oby C.
Richardson submitted a petition to the City of Marysville request-
ing the vacation of that portion of Tenth Street N.E.lying between
Cedar Avenue and the Burlington Northern Railroad right-of-way;
and
WHEREAS,on March 28,1983,the City Council received
said petition,together with the recommendations of the City Staff
with respect thereto,and determined that it would be set for pub-
lic hearing pursuant to Chapter 12.32 of the Marysville Municipal
Code;NOW,THEREFORE,
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
Section 1.A public hearing for the vacation of the
above-described street is hereby set for f/"ri I 25./C}S"3 ,
1983,at 8:00 p.m.,in the chambers of the rfclrysvilleCity Council,
4822 -72nd Street N.E.,Marysville,Washington.Twenty days writ-
ten notice of said public hearing shall be given by posting the
same in three public places in the City and by posting the same in
a conspicuous place on the subject street.
Section 2.If it is ultimately determined by the City
Council that the sUbject street shall be vacated,the petitioners
shall thereupon be required to pay the City of Marysville an amount
equalling one-half of the appraised value of the street.For the
purpose of determining said appraised value,the following data
shall be prepared at the petitioners'cost and presented to the
City Council at the time of the public hearing.
The assessed valuation of the applicants'abutting land as it
appears on the Snohomish County Assessor's records on square
footage basis.

Section 3.This Resolution shall become effective upon
the petitioner paying the $50.00 filing fee required by Section
12.32.010 of the Marysville Municipal Code.
