A RESOLUTION OF THE CITY OF MARYSVILLE AUTHORIZING
AN APPLICATION TO THE BUREAU OF INDIAN AFFAIRS FOR
A G~~T OF RIGHT-OF-WAY FOR WATER AND SEWER LINES
ON THE TULALIP INDIAN RESERVATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON,AS FOLLOWS:
The City Council hereby authorizes the filing of an appli-
cation with the Bureau of Indian Affairs for a grant of right-of-
way pursuant to provisions of 25 U.S.C.323 for the following water
and sewer lines crossing the Tulalip Indian Reservation:
A water main on the north and east sides of SR 528/33rd
Avenue N.E.
A water main on the north side of Marine View Drive.
A water main on the east side of 31st Avenue N.E.
A sewer main on the south and west sides of SR 528/33rd
Avenue N.E.
A sewer main on the north side of Marine View Drive.
The Mayor is authorized to stipulate to the following terms
and conditions for said grants of right-of-way:
(a)The consideration shall be:"$1.00 and other good and
valuable consideration."
(b)Annexation of the subject property into the City of
Marysville shall not be required as a condition of
receiving City utility service thereto.
(c)City utility service shall be available to the sub-
ject property on the terms and conditions provided
in the City Utility Code.For property affected by
the settlement agreement dated April 25,1983,the
terms and conditions of that agreement shall apply.
