RESOLUTION NO.I09/P
A RESOLUTION OF THE CITY OF MARYSVILLE APPROVING AN
URBAN RENEWAL PLAN AND AMENDING'THE CITY'S COMPREHENSIVE
PLAN TO CONFORM THERETO.
This matter came before the Marysville City Council on
December 6,1982,upon a dUly-advertised pUblic hearing.At said
hearing,and all continuances thereof,the City Council considered
the recommendations and reports of the Downtown Redevelopment
Commission,the City Planning Commission and the City staff,and
further considered the Environmental Impact Statement,all written
comments and responses contained therein,and the testimony of all
members of the public in attendance at the pUblic hearings,and on
the basis thereof hereby enters the following Findings of Fact:
1.By Resolution 1011 adopted by the City Council on June 8,
1981,the following-described downtown area of the City of
Marysville was declared to be blighted:
All that area of the City of Marysville situated South
of Fourth Street,West of State Avenue,North of Ebey
Slough and East of Cedar Avenue.
2.Pursuant to said resolution an Urban Renewal Agency
("Downtown Redevelopment Commission")was appointed and charged
with the responsibility of proposing an Urban Renewal Plan
pursuant to RCW 35.81.
3.The Plan proposed by the Downtown Redevelopment
Commission was considered,at public hearings,by the City
Planning Commission.Said Commission submitted its written
recommendations with respect thereto,finding that the Plan was in
conformity with the Comprehensive Plan for the development of the
City as a whole,and a necessary and appropriate means of
rehabilitating the downtown area.
4.The Plan does not propose the displacement of any persons
from their residences.If,however,condemnation of any
residences becomes necessary,a precondition of such condemnation
shall be the development of a workable and feasible plan to make
housing available for any displaced persons.

5.The Plan conforms to the Comprehensive Plan,as amended,
for the City as a whole.
6.The Plan will afford maximum opportunity,consistent with
the sound needs of the City as a whole,for the rehabilitation or
redevelopment of the Urban Renewal Area by private enterprise.
7.A sound and adequate financial program exists for
financing the proposed project.

The urban renewal project area is a blighted area as
in RCW 35.81.010(2)for the reasons stated in Resolution
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS:
Section 1.Comprehensive Plan Amended.The Comprehensive
Plan of the City of Marysville is hereby amended to incorporate by
reference the Urban Renewal Plan referred to in Section 2 below.
Section 2.Ado tion of Urban Renewal Plan.Pursuant to RCW
35.81.060 4 the C1ty hereby adopts an Urban Renewal Plan for the
above-described area,said Plan consisting of the following
elements:
1.A written description of the Plan featuring a market
element,a land-use element,a pedestrian element,a
building element,an urban-design element,a
traffic/parking element and a waterfront element.
2.An implementation program designed to afford the
maximum opportunity for the rehabilitation and
redevelopment of blighted areas by private enterprise
through voluntary action coupled with the City's
regulatory process.Said program includes
recommendations to establish a Downtown Redevelopment
Commission,to adopt a unique zoning code for the
Downtown Business District,to dispose of City-owned
real estate located within the redevelopment area,to
make major capital improvements to utilities,roads and
pedestrian walkways in the redevelopment area,to
finance the project from pUblic and private resources,
and to stimulate demolition of existing structures and
development of a new and improved Downtown Business
District,through the efforts of private land owners.

3.The enactment of Chapter 19.21 of the Marysville
Municipal Code establishing a Downtown Business District
zone;and the enactment of Chapter 19.22 of the
Marysville Municipal Code establishing the Downtown
Redevelopment Commission and adopting development
controls for the Downtown Business District.
Section 3.Flexibility of Plan.It is the intent of the
City Council that the elements of the Urban Renewal Plan adopted
herein,including the maps establishing Zones of Influence and a
Conceptual Development Plan for properties in the Downtown
Business District,shall remain flexible throughout the downtown
redevelopment process.Rezones modifying said elements of the
Plan may be liberally granted in cases where an alternative is
proposed which meets the goals and objectives of the Plan and is
consistent with rehabilitation and redevelopment of the urban
renewal area as a whole.
Section 4.Review of Plan.Upon reviewing proposals for
development of City-owned property in the Downtown Business
District,but within twelve (12)months of the date of this
resolution,the City Council shall review the Urban Renewal Plan,
and the legislation implementing the same.
Section 5.Precondition for Condemnation.The City shall
not exercise its right of eminent domain pursuant to RCW 35.81.080
for the purpose of acquiring any property within the Downtown
Business District which will thereafter be sold or leased to
private parties,unless and until a bona fide offer has first been
made to the property owner to purchase said property at its
then-current fair market value,as determined by a qualified
appraiser.Only if such an offer is refused by the property owner
will the City proceed to condemn the property.
Section 6.Severability.The provisions of the Urban
Renewal Plan adopted herein are severable,and if any provision,
sentence,clause,section or part thereof is held illegal,
invalid,or unconstitutional or inapplicable to any person,
property or circumstance,it shall not affect or impair any of the
remaining provisions,sentences,clauses,sections or parts of the
Plan or their application to other persons,property or
circumstances.It is hereby declared to be the intent of the City
Council that this Urban Renewal Plan would have been adopted if
such illegal,invalid or unconstitutional provision,sentence,
clause,section or part had not been included therein,and if the
person,property or circumstances to which the Plan or any part
thereof is inapplicable had been specifically exempted therefrom.
