A RESOLUTION OF THE CITY OF MARYSVILLE SUPPLEMENTING
THE RUSA PLAN BY INCLUDING CERTAIN PROPERTY ON THE
WEST SIDE OF 1-5
WHEREAS,Sections 14.32.030 and 14.32.050(1)of the
Marysville Municipal Code require the adoption of a Rural Utility
Service Area Plan for all properties located outside of the City
limits which seek City utility services;and
WHEREAS,such a RUSA Plan was duly adopted by the Marys-
ville City Council and recorded in the records of the Snohomish
County Auditor under Auditor's file no.8208120212;and
WHEREAS,certain properties on the west side 1-5 were
omitted from the original RUSA Plan,and it is necessary to supple-
ment said Plan by including the same;and
WHEREAS,public hearings on said supplements to the RUSA
Plan were held by the City on April 9,1985,and May 20,1985;NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYS-
VILLE,WASHINGTON,AS FOLLOWS:
Section 1.The Rural Utility Service Area Plan is hereby
supplemented with respect to that certain property located on the
TUlalip Reservation bounded on the east by 1-5,on the west by 31st
Avenue N.E.,on the north by 66th Street N.E.,and on the south by
Ebey Slough,a map of the same being attached hereto and incorporated
herein by this reference.City utility services to said property
shall be used exclusively for the following land uses:
1.Uses (permitted and conditional)which would be allowed
for Industrial Park Zones as defined in Chapter 18.56 and Business Park
Zones as defined in Chapter 18.55 of the Snohomish County Code which
is in effect on the date of this resolution in areas to which that
Code would otherwise be applicable.Failure of any proposed use to
conform to "performance standards"of such County Code shall not
constitute reason for denial of service,such as building height,
sign height,setbacks,etc.

2.Other uses consistent with an "entertainment
theme"including such uses as a hotel-motel,restaurant,health
spa and other similar uses which are incident and supportive of
the entertainment theme of the TUlalip Tribes'entertainment
center.
3.Service stations,fast food establishments (e.g.
McDonald's),convenience stores (e.g.7-11 or minimart type stores).
4.No other uses shall be permitted without a variance
issued by the City Council in accordance with the provisions of
Section 14.32.060(d)of the Marysville Municipal Code.
Section 2.The Rural Utility Service Area Plan is hereby
supplemented with respect to that certain property located on the
Tulalip Reservation known as the Plat of Tierra Bonita and the Plat
of Marysville West,said plats being depicted on Exhibit "A"attached
hereto and incorporated herein by this reference.City utility ser-
vices are hereby authorized to said properties exclusively for single-
family residential developments with a minimum lot size of 7,200 sq.
ft.per lot.
Section 3.The City hereby grants a permanent variance
for utility service to the above-described properties from any
annexation requirement which may now or hereafter exist in the
Marysville Municipal Code.
