F;le; CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.1/71, A RESOLUTION OF THE CITY OF MARYSVILLE AMENDING THE CONDITIONS FOR APPROVAL OF THE PRELIMINARY PLAT OF MUNSON CREEK ESTATES WHEREAS on June 18,1984 the City Council approved the preliminary plat of Munson Creek Estates,and attached conditions to said approval;and WHEREAS certain administrative modifications of said conditions have been found to be necessary,and the same are in the public interest;NOW THEREFORE BE IT RESOLVED by the City Council of the City of Marysville,Washington as follows: The revised conditions for the preliminary plat of Munson Creek Estates,a copy of the same being attached hereto as Exhibit A,are hereby approved.The effective date of the preliminary plat shall remain as originally stated. EXHIBIT A CONDITIONS FOR PLAT OF MUNSON CREEK ESTATES 1.Vegetation and Buffer Zones --Grading Plan.Because of the steep slopes and site-sensitive conditions of this plat,all development must minimize clearing activity and disruption of natural topography.Before on-site construction commences,a grading and selective clearing plan will be submitted for review and approval by the City staff.Said plan shall include a 20-foot vegetative screen along the common boundary line between Lot 78 (Phase V)and the condominium development (Phase IV). 2.Storm Drainage.The owner shall provide for storm drainage of the subject property in compliance with the Southeast Marysville Regional Storm Water Management Program,as adopted by Resolution 1100.A temporary erosion control facility shall be constructed prior to development of Phase I.A storm drainage retention facility shall be constructed and operational prior to any additional construction activity in any phase of the plat.Said facility shall be located on the site deeded in Phase IV of the plat.If said facility is constructed by the City,or by any party other than the owner,the owner shall pay its proportionate share of the cost of the same pursuant to Section 18.24.045 of the Marysville Municipal Code.Said payment shall be made prior to final plat approval for each phase of the plat.If the facility is constructed at-the owner's cost,the City shall grant the owner a recovery contract pursuant to Section 18.24.045 whereby other property owners in the drainage basin will be thereafter required to contribute their proportionate share of such costs.Such contract shall be recorded in the records of the Snohomish County Auditor and shall constitute a lien against all properties within the drainage basin for a period of fifteen (15)years. All storm drainage lines and improvements on the SUbject property shall comply with Chapters 14.15 and 14.16 of the Marysville Municipal Code,and the owner shall pay all fees provided for therein. 3.Public Street Improvements.The owner shall be required to make the following pUblic street improvements: (a)Prior to final plat approval of Phase I,the owner shall dedicate ten (10)additional feet of right-of-way on the east side of 71st Avenue N.E.,and construct a one-half street improvement to the centerline of 71st Avenue N.E. (including curbs,gutters,sidewalks,storm drainage and street lighting)for the full abutting frontage of the plat.Also,prior to final plat approval of Phase I, Conditions - 1 l ..'. the owner shall construct that portion of 76th Street N.E.abutting lot 5 of Phase I to full design standard "A"specifications,including curbs,gutters,sidewalks, storm drainage and street lighting,and shall dedicate the same to the City free and clear of any private easements. (b)Prior to final plat approval of Phase II,the owner shall improve 76th Street N.E.from 67th Avenue N.E.to the plat,to a temporary standard approved by the Public Works Director.Said temporary standard shall constitute adequate access for no more than 41 lots. (c)Prior to providing access to more than 41 dwelling units,76th Street N.E.between 67th Avenue N.E.and the south boundary of the proposed Plat of Forest Hill Estates,shall be constructed per De sign Standard "A," including curbs,gutters,sidewalks,storm drainage and street lighting.Said construction may be financed by a local improvement district including all benefitted properties.Before recording the final plat for Phase II of the Plat of Munson Creek Estates,the owner shall record a covenant not to protest a 76th Street N.E. L.I.D.,which covenant shall be binding upon property in all phases of said plat.If a L.I.D.is not,or cannot, be formed for 76th Street N.E.,the owner shall only be required to build 76th Street N.E.from 67th Avenue N.E. to the south boundary of the Plat of Munson Creek Estates. The City shall have the discretion to align the location of the 76th Street N.E.extension to be consistent with the City's Comprehensive Plan for this region. (d)All internal streets within the plat,excluding the 76th Street extension,shall be constructed per Design Standard "E,"including curbs,gutters,sidewalks,storm drainage and street lighting.Construction shall be completed or bonded prior to recording of the final plat for each affected phase. (e)A variance is hereby approved for the street grade at one location on the internal street of Phase III and one location on the internal street of Phase IV.Said variances shall allow the slope to exceed 10%,with a maximum slope not to exceed 16%. 4.Easements. (a)The owner shall grant an easement to the City,at no cost,for a sanitary sewer line crossing the sUbject property in an east-west direction as an extension of 76th Street N.E. Conditions -2 (b)Prior to recording of the final plat of Phase II,the owner shall obtain the release and termination of an existing access easement crossing the subject property for the benefit of property owned by Manuel E.Costa and Matilda J.Costa,7509 -76th N.E.,Marysville, Washington. 5.Condominium Site.Prior to recording the final plat of Phase IV, the owner shall submit a binding site plan for approval by the Planning Commission and the City Council showing the same level of detail for the condominium area within said phase as is required in Section 19.48.060 for planned residential developments.The following limitations shall apply to said condominium development: All condominium units shall be limited to a single story above front (street side)entrance grade.No more than six (6)units may be attached to one another.Minor modifications to the condominium plans may be made SUbject to staff approval. 6.Underground Utilities.All utility services in the plat will be underground. 7.Phasing.This project shall be developed in five (5)phases as shown on the preliminary plat.Phases I and II shall be developed first;numerical sequence thereafter shall be in the discretion of the owner.Final plat approval may be given to individual phases upon all conditions,standards and requirements applying to each such phase being fulfilled.The density of development within each phase will not exceed the following: Phase I ..• Phase II ••• Phase III ... Phase IV •.. Phase V ••. 5 single-family detached dwelling units abutting 71st Avenue N.E. 28 single-family detached dwelling units 8 single-family detached dwelling units 13 single-family detached dwelling units,plus 30 condominium units 24 single-family detached dwelling units 8.Legal Requirements.The owner,its successor and assigns,shall comply with all City codes and regulations applicable to the development and use of the property,and nothing herein shall be construed as superseding said codes and regulations.
