HomeMy WebLinkAboutR-1189 - Declaring its intention to initiate the formation of Utility Local Improvement District No. 10 to carry out the system or plan of additions to and bet, X(.;F.le: CITY OF MARYSVILLE,WASHINGTON RESOLUTION NO.~ A RESOLUTION of the City Council of the City of Marys- ville,Washington,declaring its intention to initiate the formation of Utility Local Improvement District No. 10 to carry out the system or plan of additions to and betterments and extensions of the waterworks utility of the City,including the system of sewerage as a part there- of,as adopted by Ordinance No.937 to serve certain areas of the City,all as applicable to such utility local im- provement district;and fixing the date,time and place for a public hearing on the formation of the proposed util- ity local improvement district. WHEREAS,the City of Marysville,Washington (hereinafter called the "City"),by Ordinance No.385 passed September 2, 1952,combined the sewerage system of the City and all additions and improvements thereto with the waterworks utility of the City,and the sewerage system at all times since has been con- sidered a part of and belonging to the waterworks utility of the City,and the words "waterworks utility .o f the City"shall hereinafter mean the combined sewerage system and water system of the City,together with all additions thereto and betterments and extensions thereof hereafter made;and WHEREAS,pursuant to Ordinance No.937 passed July 9,1979, the City Council in adopting the Lower Snohomish River Basin Waste Water Facilities Planning Study for the Marysville Sub- region,specified and adopted a system or plan of additions to and betterments and extensions of the waterworks utility of the City;and -• WHEREAS,the City Council has determined it to be in the best interests of the City that such system or plan of additions to and betterments and extensions of the waterworks utility of the City be undertaken and that a utility local improvement district be formed within the areas hereinafter more partic- ularly described;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYS- VILLE,WASHINGTON,as follows: Section 1.It is the intention of the City Council of the City to order the acquisition and construction of the por- tions of the system or plan of additions and betterments and extensions of the waterworks utility of the City as adopted in Ordinance No.937 passed by the City Council and approved by the Mayor on July 9,1979,to serve certain areas of the City and applicable to the proposed utility local improvement district hereinafter described.The nature and territorial extent of such proposed improvement consists of the construction and installation of the following sewer collection system as units of the improvement together with all necessary appurt- enances: A series of sanitary sewer lines beginning approximately 1310 feet south of the intersection of 35th Avenue NE (Pac- ific Highway)and Shalbin Road (169th Street NE),then extending north 1310 feet plus or minus to the intersection of 35th Avenue NE and 169th Street NE,then continuing west along 169th Street NE approximately 2650 feet to the intersection of 169th Street NE and 27th Avenue NE;then extending north along 27th Avenue 860 feet plus or minus to the intersection of 27th Avenue NE and l72nd Street NE. -2- Section 2.To carry out the foregoing system or plan of additions to and betterments and extensions of the waterworks utility of the City,there shall be formed an utility local improvement district to be known and designated as "Utility Local Improvement District No.10 of the City of Marysville, Washington,"the boundaries of which are described in Exhibit "A"attached hereto and by this reference made a part hereof. Section 3.The estimated cost and expense of the portion of the system or plan of additions to and betterments and exten- sions of the waterworks utility of the City applicable to ULID No.10,is hereby declared to be approximately $425,000,all of which shall be borne by and assessed against the property included within proposed Utility Local Improvement District No.10,all being the property specially benefited by each con- tinuous unit of such improvement.The assessments in such util- ity local improvement district shall be for the sole purpose of payment into the "Water and Sewer Revenue Refunding Bond Fund,1977,"in the event that the water and sewer revenue bonds authorized to be issued to pay for the improvements in ULID No.10 shall be issued on a parity of lien with the outstanding bonds payable out of such fund;otherwise,such assessments shall be for the sole purpose of payment into a special bond redemption fund to be hereafter created for the payment of water and sewer revenue bonds to be hereafter issued by the City to provide the funds required to pay the cost and expense of carry- -3- r- ing out such system or plan.The assessment rates shall be computed on the basis of the cost and expense of each unit. Section 4.A public hearing on the formation of Utility Local Improvement District No.10 shall be held in the Council Chambers in the City Library,Marysville,Washington,at 7:30 o'clock p.m.(PST)on January ~~86,at a regular meeting:2.1 of the City Council then to be held at such time and place. All persons who may desire to object to the improvement and to the formation of the proposed utility local improvement district are hereby notified to appear and present their objec- tions at the hearing and meeting of the City Council to be held at such time and place. Section 5.Larry R.Wade of Hammond,Collier &Wade- Livingstone Associates,Inc.,the City's consulting engineers, is hereby directed tO~bmit to the City Council on or prior ~6/J· to January ~,198Z/V 1 data and information required by law'2.7 to be submitted.
