A RESOLUTION OF THE CITY OF MARYSVILLE DENYING
A REZONE APPLICATION FOR PROPERTY LOCATED AT
1231 BEACH AVENUE

WHEREAS,MIKE APKER and TOM BECKER are the owners of certain
real property located at 1231 Beach Avenue,Marysville,Washington,
and have applied for a rezone of said property from the Single-
Family classification to the Low-Density Multiple-Family classifi-
cation;and
WHEREAS,the Planning Commission held a public hearing on
said application on January 14,1986,and adopted Findings of
Fact which supported a recommendation of denial;and
WHEREAS,on January 27,1986,the City Council considered said
recommendation and determined that it was in the public interest
to uphold the same;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON,AS FOLLOWS:
The application of MIKE APKER and TOM BECKER for a rezone of
property located at 1231 Beach Avenue,Marysville,Washington,from
the Single-Family classification to the Low-Density Multiple-Family
classification is hereby DENIED.This denial is based upon the
testimony and exhibits presented at the Planning Commission hear-
ing on January 14,1986,and upon the following Findings of Fact:
1.The applicant has failed to demonstrate a change of cir-
cumstances in the neighborhood which justify rezoning the sUbject
property to the Multiple-Family classification.
2.Testimony of the property owners in the surrounding neigh-
borhood demonstrated that the existing and foreseeable character of
this neighborhood is suitable only for single-family houses.Said
houses are predominantly occupied by persons who own the same,as
opposed to tenants.A large number of the owners are retired per-
sons who would be adversely affected by a sudden change in the
character of the neighborhood.

3.The area proposed for development is located behind an
existing single-family house.This type of "back yard"develop-
ment of apartment units is not in the public interest.It pro-
motes overcrowded conditions,inadequate open space and land-
scaping,and hazards to public health and safety.
4.The proposed development would result in larger numbers
of children residing in the neighborhood.The safety of these
children would be endangered by the present traffic conditions on
Beach Avenue.No mitigation measures were proposed by the appli-
cant.
