CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.1204.- A RESOLUTION OF THE CITY OF MARYSVILLE ADOPTING A COST-SHARING POLICY FOR PAVING OF ALLEYS BE IT RESOLVED by the City Council of the City of Marysville, Washington,as follows: Section 1.Cost-Sharing Program.The City hereby adopts a program of sharing the cost of improving and paving any and all alleys in the City on a 50/50 cost-sharing basis with the private property owners abutting said alleys. Section 2.Preconditions for Participation. conditions must be complied with in full prior to by the City in the improvement of any alley: The following participation (a)Property owners abutting the alley,on both sides,shall dedicate to the City sufficient right-of-way to widen the alley to the full width,as measured from the design centerline,so as to conform to the applicable standard specified by the City Engineer;or prove to the satis- faction of the City Engineer that said public ownership already exists. (b)Property owners abutting the alley shall agree,in writ- ing,to pay 50%of the cost of paving and improving the alley to City specifications.The entire length of the alley must be improved as a single project. Section 3.Construction.Construction of any alley project shall be under the direction and supervision of the city and shall meet construction specifications approved by the City Engineer.All costs shall be paid by the city,subject to 50%reimbursement by the private property owners. Section 4.Payment by Private Property Owners.Property owners who agree,in writing,to participate in an alley improvement pro- gram shall be required to pay the City their pro-rata share of the cost of such improvements within thirty (30)days of completion of the project.Delinquent accounts shall accrue interest at the rate of twelve percent (12%)per annum,and shall constitute a lien against the subject property which is binding upon the owners,their Resolution - 1 . ~... heirs,successors and assigns,until the delinquency,plus accrued interest,is paid in full. Section 5.Disqualification.No property owner shall be qualified to participate in this ,program if said owner would other- wise be required to construct the alley improvements 100%at his own cost pursuant to the conditions of a subdivision approval,con- ditional use permit or mitigation contract. Section 5.Duration of Policy.This policy shall continue in force and effect subject to modification or termination by the City Council at the time of adoption of each annual budget ordinance.
