A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE
TO LARRY PAVISH FOR THE CONSTRUCTION OF CURBS,GUTTERS
AND SIDEWALKS
WHEREAS,LARRY PAVISH is the owner of a square block of com-
mercial real estate in downtown Marysville which is bounded on
the north by Second Street N.E.,on the east by Ash Avenue,on
the south by First Street N.E.,and on the west by Beach Street;
and
WHEREAS,said owner plans to convert the use of said property
from residential to commercial,and would be required by Section
12.02.170 of the Marysville Municipal Code to construct curbs,
gutters and sidewalks on all abutting street frontages;and
WHEREAS,the owner applied for a variance per the requirements
of Section 12.02.170,and public hearings on said variance appli-
cation were held by the City Council on April 28,1986 and May
12,1986,and the following Findings and Facts were entered:
a.The subject property is presently occupied by two rental
houses.
b.The owner intends to convert the property to commercial
uses;on a temporary basis such uses will consist of a
recreational vehicle sales lot and perhaps a public
market.
c.There are no current plans for a permanent,long-range
commercial use of the property or the construction of
any new buildings thereon.
d.Ash Avenue was relocated at the time the freeway was
constructed,and does not constitute a full-service
City street requiring improvement with sidewalks.
e.First Street N.E.is already improved with curbs,gutters
and sidewalks.
f.Second Street N.E.and Beach Avenue are already improved
with sidewalks,but have no curbs or gutters.
Based upon the foregoing Findings of Fact,the City Council

of the City of Marysville,Washington hereby resolves as follows:
1.Within thirty (30)days of the date of this resolution
the owner shall construct curbs and gutters for the
full abutting frontage on Ash Avenue,Second Street
N.E.and Beach Avenue.
2.A variance from Section 12.02.170 is hereby granted,
and the owner shall not be required to construct sidewalks
on Ash Avenue.
3.The owner shall not be required to construct an on-site
drainage retention or detention system for so long as
no additional buildings are constructed on the site and
no impervious surface (such as a paved parking area)is
added to the site.
4.Until such time as a permanent commercial use of the
subject property is established,Section 19.36.090 (1)
of the Marysville Municipal Code,requiring paved parking
stalls,shall be waived.
