HomeMy WebLinkAboutR-1245 - Accepting a petition for the Witscher annexation and fixing a date for public hearing thereonCIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.,'J.ltS RESOLUTION OF THE CITY OF MARSYVILLE ACCEPTING A PETITION FOR THE WITSCHER ANNEXATION,AND FIXING A DATE FOR PUBLIC HEARING THEREON WHEREAS,on /IJ,ve.m.be;r 2i.f ,1986 the City of Marysville received notice that certain parties desired to annex the property described in Exhibit A attached hereto,said notice being signed by the owners of not less than 10%in value of the property in question; and WHEREAS,the City Council agreed that the annexation proposal would be given formal consideration if it met the following terms and conditions: a.A petition would have to be filed within six months signed by the owners of not less than 75%in value of the property in question. b.A bona fide effort should be made to include the entire plat of Emerald Estates within the annexation territory. c.The annexation territory would include,at a minimum, the boundaries of ULID #12. d.If the annexation is ultimately approved,the compre- hensive plan which the City has heretofore prepared for the subject property would become the officially adopted comprehensive plan for the annexation terri- tory. e.If the annexation is ultimately approved the City would require the assumption of all the existing City indebted- ness by the annexation territory. WHEREAS,on February 2,1987 the City recieved a petition for annexation of the subject property,said petition having been signed by the owners of not less than 75%in value of said property;NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON AS FOLLOWS: 1.A pUblic hearing before the Marysville City Council is hereby scheduled for February 23,1987 at 8 p.m.at the Marysville City Council Chambers,4822 -72nd Street N.E.,Marysville,Washington. At said public hearing the City Council shall determine whether the proposed annexation is in the public interest and whether the same should be referred to the Snohomish County Boundary Review Board. Resolution II .;),.., Notice of the pUblic hearing shall be published and posted as required by RCW 35A.14.l30. 2.If the property owned by Belmark Industries,Inc.,commonly known as the Plat of Oakwood Estates,is ultimately included in the annexation,the City agrees that the following conditions will apply to said property: a.The City will accept the preliminary Blat of Oakwood Estates,as approved by Snohomish County,on the following conditions: (1)Public roads in the plat will meet or exceed City road specifications for construction in a 50-foot-wide right of way. (2) The plat will be modified so that the lots in the southeast corner will have a minimum front- age of 40 feet. (3) No lot shall be less than 70 feet wide. b.The City agrees that the three oversized lots in the northern part of the Plat of Oakwood Estates may be short platted pursuant to the procedures of the City short plat code. c.The owner of the plat shall dedicate sufficient width along its frontage on 88th Street N.E.to meet the City's standards for an 80-foot right of way,and the owner shall grant the necessary slope easements.Further,the owner shall construct frontage improvements within the public right of way consisting of an asphalt pedestrian pathway.
