RESOLUTION NO.1257
A RESOLUTION OF THE CITY OF MARYSVILLE APPROVING A
BINDING SITE PLAN FOR THE TOWNE CENTRE MALL.
WHEREAS,on April 13,1987 the City Council at a duly
advertised public hearing reviewed the proposed construction of
the Towne Centre Mall in the six square-block area bounded by
Fourth Street on the north,State Avenue on the east,First
Street on the south,and Cedar Avenue on the west;and
WHEREAS,a Site Plan was presented,including scaled
renderings showing the elevations and architectural features of
all proposed buildings;and
WHEREAS,the City Council finds that said exhibits are
consistent with all City codes and regulations,and meet the
public interest,on the condition that certain specified require-
ments are met in the course of construction;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYS-
VILLE,WASHINGTON,AS FOLLOWS:
1.The Site Plan for the Towne Centre Mall which was
presented to the City Council on April 13,1987,a copy of which
is on file in the records of the City Compliance Officer,is
hereby accepted by the City and shall constitute a Binding Site
Plan pursuant to RCW 58.17.020(7).The City staff is authorized
to administratively approve minor changes in said Binding Site
Plan relating to the design,layout and landscaping of the
parking lot and pedestrian ways.Any and all other changes to
the Binding Site Plan shall require approval by the City Council.
2.Prior to the 31st day of December,1987,the proponent
shall cause an adequate traffic study to be prepared and sub-
mitted to the City Council.Said study shall comply with the
requirements of Chapter 2GB.53 of the Snohomish County Code and
shall provide an analysis of all streets and intersections which
will carry 10%or more of the traffic generated by the project,
including highways under State jurisdiction.Further,the
traffic study shall provide growth projections with a two year
horizon.The traffic study shall be submitted for review and
comment by the Washington State Department of Transportation,the
Snohomish County Department of Public Works and the Tulalip
Tribes.In cooperation with said governmental agencies,and
subject to approval by the City of Marysville,mitigation
measures shall be proposed for all significant adverse traffic
impacts which result from the Shopping Mall.The proponent shall
not,as a result of causing the traffic study to be prepared and

mitigation measures proposed,be obligated for regional improve-
ments any more than any other benefited property owner,as
provided by law.Actual construction of regional improvements,
as outlined within the traffic study,shall not be a pre-condi-
tion to construction or occupancy of this project.
3.Pursuant to Chapter 70 of the uniform Building Code,
grading and filling permits shall be obtained from the City
Compliance Officer before work begins on the project site.
4.Pursuant to Section 14.15.040(2)of the Marysville
Municipal Code,a detailed drainage plan shall be submitted by
the proponents before work begins on the project site.
5.Each of the streets and alleys which will be vacated as
part of this project shall remain open for public access and
subject to public regulation and the police powers of the City
until such time as the proponent determines that its construction
project has reached a stage where it is necessary to close said
street or alley in the interest of public safety.At least one
week's advance notice of the closure date of each street and
alley shall be provided to the City in writing.From and after
the closure of each street and alley the proponent shall assume
full liability for any injuries or damages arising from the use
or occupancy of said street or alley,and shall indemnify and
hold the City,its agents and employees,harmless from such
liability.The proponent will use its best efforts to keep the
Third Street access to the City Fire Department building open and
usable for as long as possible.
6.In the event that it is necessary to relocate any
existing utility lines in the Shopping Mall area,the same shall
be done at the cost of the proponents and without any interrup-
tion of service to abutting properties.Provided,that this
requirement shall not apply to utility lines which the City will
reconstruct for its own purposes at its cost.
