HomeMy WebLinkAboutR-1263 - Supplementing the rural utility service area plan by including certain property on the west side of I-5.~.' -lor."'f ~.• CIT Y 0 F MAR Y S V ILL E Marysville,Washington RESOLUTION NO.J:2 w3 A RESOLUTION OF THE CITY OF MARYSVILLE SUPPLEMENTING THE RURAL UTILITY SERVICE AREA PLAN BY INCLUDING CERTAIN PROPERTY ON THE WEST SIDE OF I-5 WHEREAS,Sections 14.32.030 and 14.32.050(1)of the Marysville Municipal Code require the adoption of a Rural Utility Service Area Plan for all properties located outside of the City limits which seek City utility services;and WHEREAS,such a RUSA Plan was duly adopted by the Marysville City Council and recorded in the records of the Snohomish County Auditor under Auditor's File No.8208120212;and WHEREAS,certain properties on the west side of I-5 have applied for inclusion within the City's RUSA boundaries,and the City has held duly advertised public hearings on said applica- tions;and WHEREAS,on May 12,1987 the Snohomish County Boundary Review Board waived jurisdiction over these proposed extensions of the RUSA boundary;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: Section 1.The boundaries of the Rural Utility Service Area are hereby extended to include 37.5 acres located west of I-5 and north of 140th St.N.E.known as Nina Lake Estates,a map and legal description of which are attached hereto as Exhibit A and incorporated herein by this reference.City utility services to said property shall be subject to compliance with all provisions of Title 14 of the Marysville Municipal Code,and a Utility Service Contract which shall be recorded in the records of the Snohomish County Auditor.A Rural Utility Service Area Plan is hereby adopted for said property designating the same in the following land use category:Single Family Residential,with a maximum density of 2.2 lots per net acre. Section 2.The boundaries of the Rural Utility Service Area are hereby extended to include 187.55 acres on the west side of I-5 in the vicinity of the 172nd St.N.E.interchange,said property consisting of 4 separate parcels,a map and legal description of which are attached hereto as Exhibit Band Resolution - 1 --------------_._.._- I"·•., incorporated herein by this reference.City utility services to said properties shall be subject to compliance with all pro- visions of Title 14 of the Marysville Municipal Code,and the provisions of Resolution 1241 of the Marysville City Council.A Rural Utility Service Area Plan is hereby adopted for said properties designating the same in the following land use categories:Rural Use,Multiple Residential,Neighborhood Business,Planned Community Business and Freeway Service,as depicted on the map included in Exhibit B attached hereto. ..hD0PTED2hdayof bl~e City Council and APPROVED by the Mayory,1987.
