A RESOLUTION of the City Council of the City of
Marysville,Washington,declaring its intention to
initiate the formation of Utility Local Improvement
District No. 12 to carry out the system or plan of
additions to and betterments and extensions of the
waterworks utility of the City,including the system
of sewerage as a part thereof,as adopted by Ordi-
nance No. 937 to serve certain areas of the City,all
as applicable to such utility local improvement
district;and fixing the date,time and place for a
public hearing on the formation of the proposed
utility local improvement district.
WHEREAS,the City of Marysvi Ll e ,Washington (the "Ci ty")r
by Ordinance No. 385 passed September 2,1952,combined the
sewerage system of the City and all additions and improvements
thereto with the waterworks utility of the City,and the sewer-
age system at all times since has been considered a part of and
belonging to the waterworks utility of the City,and the words
"waterworks utility of the City"hereinafter shall mean the
combined sewerage system and water system of the City,together
with all additions thereto and betterments and extensions
thereof hereafter made;and
WHEREAS,pursuant to Ordinance No. 937 passed July 9,1979,
the City Council in adopting the Lower Snohomish River Basin
Waste Water Facilities Planning Study for the Marysville Sub-
region specified and adopted a system or plan of additions to
and betterments and extensions of the waterworks utility of the
City;and
WHEREAS,the City Council has determined it to be in the
best interests of the City that a portion of such system or plan

of additions to and betterments and extensions of the waterworks
utility of the City be undertaken and that a utility local
improvement district be formed within the area hereinafter more
particularly described;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON,as follows:
Section 1.It is the intention of the City Council of the
City to order the acquisition and construction of the portion of
the system or plan of additions and betterments and extensions
of the waterworks utility of the City as adopted in Ordinance
No. 937 passed by the City Council and approved by the Mayor on
July 9,1979,to serve a certain area of the City and applicable
to the proposed utility local improvement district hereinafter
described.The nature and territorial extent of such proposed
improvement consists of the construction and installation of the
sewer improvements together with all necessary appurtenances,
more particularly described in Exhibit A attached hereto and
incoporated herein by this reference.
Section 2.To carry out the foregoing system or plan of
additions to and betterments and extensions of the waterworks
utility of the City,there shall be formed a utility local
improvement district to be known and designated as Utility Local
Improvement District No. 12 of the City of Marysville,
Washington,the boundaries of which are described in Exhibit B
attached hereto and incorporated herein by this reference.

Section 3.The estimated cost and expense of the portion
of the system or plan of additions to and betterments and exten-
sions of the waterworks utility of the City applicable to ULID
No. 12 is declared to be approximately $535,000,all of which
cost shall be borne by and assessed against the property
included within proposed Utility Local Improvement District
No.12,which district embraces as nearly as practicable all
property specially benefited by such improvements.The assess-
ments in that utility local improvement district shall be for
the sole purpose of paying the cost and expense of the improve-
ments or for payment into the Water and Sewer Revenue Refunding
Bond Fund,1977,in the event that water and sewer revenue bonds
hereafter are authorized to be issued to pay for all or a part
of the improvements in utility Local Improvement District No. 12
and such bonds are issued on a parity of lien with the outstand-
ing bonds payable out of such fund or,if not issued on a parity
of lien therewith,for payment into a special bond redemption
fund hereafter created for the payment of water and sewer reve-
nue bonds hereafter authorized to be issued by the City to
provide the funds required to pay all or a part of the cost and
expense of carrying out such system or plan.
Section 4.In accordance with the provisions of RCW
35.44.047,the City may use any method or combination of methods
to compute assessments which may be deemed to fairly reflect the
special benefits to the properties being assessed.

Section 5.A public hearing on the formation of Utility
Local Improvement District No. 12 shall be held in the Council
Chambers in the City Library,Marysville,Washington,at
7:30 p.m.,local time,on July 27,1987,at a regular meeting of
the City Council then to be held at such time and place.
All persons who may desire to object to the improvement and
to the formation of the proposed utility local improvement
district are notified to appear and present their objections at
the hearing and meeting of the City Council to be held at such
time and place.
Section 6.Larry R. Wade of Hammond,Collier &Wade-
Livingstone Associates,Inc.,the City's consulting engineers,
is directed to submit to the City Council on or prior to July
27,1987,all data and information required by law to be submit-
ted.

Those portions of the South half of the Northeast quarter
of Section 22 and the South half of the Northwest quarter
of Section 23,all in Township 30 North,Range 5 East,
W.M.,described as follows:
All that portion of the South half of the Northeast quarter
of Section 22 lying East of Mercury Manor.
ALSO the West 2,263 feet of the South half of the Northwest
quarter of Section 23 lying North of Getchell Hill Road.
ALSO the East 300 feet of the West 497.87 feet of the
South half of the Northwest quarter of Section 23 lying
South of Getchell Hill Road.

Sewer mains and appurtenances beginning at an existing
manhole on 88th Street N.E.;thence extending 300 feet
southeast across Allen Creek on a constructed bridge
to a point where the line branches,one branch south
980 feet;thence east 900 feet where another branch occurs,
one branch North 870 feet,the other continuing 360 feet
east to 67th Avenue N.E.where it turns north for 200
feet and branches again,one branch continuing north
200 feet,and one east 290 feet crossing 67th Avenue
N.E.The other branch,after the Allen Creek crossing,
heads northeast 600 feet to 67th Avenue N.E.and then
follows 67th 270 feet where it branches,one branch
continuing 130 feet east and the other north 350 feet
crossing 88th Street N.E.;thence north 35 feet to the
existing pump station (to be removed);thence north 210
feet.A main beginning at the end of construction boundary
of Emerald Estates extending south to 84th Street N.E.,
together with other miscellaneous lines will provide
service within the ULID boundary lines.
